Here's the thing: As James Madison said "Facts are stubborn things." So, though we trial lawyers try to spin a bad set of facts into a beautiful portrait, Forida judges aren't stupid and figure things out pretty quickly. When presented with a bad facts case, choices: (1) make your best deal and get out of Dodge; or (2) belly up to the table and roll the dice. No bigger crap shoot than a trial with bad facts. When you crap out (any combination of 7 after the 1st roll), they rake your money off the table. Who do you blame - the lawyer; makes perfect sense.
