David Purvis advocates for families in Southeast Georgia and beyond as a partner at The Manely Firm, P.C., with practice areas that include divorce, child custody, support, and international Hague matters. Mediation was court-mandated in this case, as it is in almost every domestic relations case in this jurisdiction. The $225 mediation fee charged by this jurisdiction and paid to the mediation office is far lower than what mediation costs parties in most every other jurisdiction in the state. That said, I cannot somehow force the opposing party to agree to our offers any more than they can force my client to accept theirs. The statement that mediation could have been avoided is as far from the truth as it could possibly be. Quite frankly, there were a number of facts specific to this case that caused the parties to be at polar opposite ends in their definitions of what would be a “fair and reasonable” resolution. The case will be decided by a judge. That’s what happens when the parties cannot reach an agreement at court-ordered mediation. Additionally, this client’s statement that there were 5-10 emails total is completely false. This client emailed myself and my staff 34 times in a 3 month period. There were 40 emails from myself and the paralegal to this client in the same time period. I responded to almost all of this client’s emails within an hour of receiving them. To my knowledge, I did not miss a phone call from this client. That said, as my time is billed, unless I need something from a client, I don’t tend to initiate contact, but I do respond in a very timely manner when they need something from me. This client emailed me six days before mediation wanting to meet beforehand. As with the majority of our communications I responded within an hour and scheduled a phone conference to address his remaining questions about mediation. Our consultations are free. We believe in allowing potential clients the opportunity to meet with our attorneys with no strings attached. This client, like all others, had no obligations to us. He decided to retain us. What he overlooks in this review is that not only were our fees reasonable compared to others in the area, they were a full 40% less than opposing counsel’s in this case. Despite that, I knew every document (some 500-600 pages total) in this case and knew every detail relevant to the case. There were, in fact, significant assets at issue in this case. All that said, if opposing counsel’s “demands were far too absurd to even consider negotiating” (negotiation being the key aspect of a mediation), there’s not much else that could be done at mediation. Nothing happened to this client. We attended court mediation which did not yield a settlement. That happens sometimes. The next step is to have the judge or a jury decide the issues of this case. This client elected to proceed to that next step without me as his attorney, which he is free to do.
