Saved My Career and Future

Mickey and Rob saved both my career and future. I contacted Mr. Robert Capovilla shortly after I was notified that the Army intended to separate me. Mr. Capovilla informed me of the steps the Army would make and helped me get my defense packet together. Thankfully I had them on my case because my Arm...y appointed lawyer from TDS tried to get me investigated by CID. Rob was able to get that TDS attorney kicked off my case and got me a TDS attorney from another post. Rob handled all contact with the military prosecution and let me know everything that the Army was doing behind the scene. The Army set a board date that Rob was not able to make because of another trial, so after a conference between Rob, Mickey and I, we decided not to give the Army more time to prepare, and Mickey took up the case. Mickey came down the day before the board to go over all the evidence, character statements, and my testimony multiple times with me. I went into the separation board with a plan of action, confident and prepared. Mickey destroyed the military prosecutor,and the board found me not guilty. I had 12 years of decorated service in special operations. Rob and Mickey saved my career, retirement and VA benefits. I would not trust another law firm with my future on the line. Experienced UCMJ Lawyer

In the fall of 2018 I was notified that I was under investigation for sexual assault. I didn't think that I'd need much more help than the USAF ADC, but then it came to light that OSI thought I had assaulted 2 separate women. That's when my Wife and I knew we needed to retain a dedicated professional.... I made contact with Mr. Capovilla and he listened to my initial situation and circumstances for the next 1.5 hours. After that, I paid the retainer fee and his services and availability were mine to use, to include his own investigation team. Over the next few months, he would periodically check in on me to see how I was doing and we'd share updates with one another on what my command had said or what base legal had told him. *I CAN NOT STRESS ENOUGH, THAT YOU WILL WANT TO RETAIN A PRIVATE LAWYER WHO CAN DEDICATE EXTRA TIME TO YOUR CASE. THE MILITARY HAS AN AGENDA RIGHT NOW WITH SEXUAL ASSAULT, AND IT DOES NOT MATTER TO THEM IF THERE IS LITERALLY NO EVIDENCE OR EVEN IF IT'S SHOWN DURING THE INVESTIGATION THAT THE "VICTIM" LIED; THE MILITARY WILL TRY TO PROSECUTE YOU!* After AF OSI had decided what they had was enough to charge me with a crime without doing their due diligence of interviews with all those involved, he let me know right away. It came to light that the Air Force intended to take me to Special Court Martial for Abusive Sexual Contact for just 1 person. After much time and deliberation, the Air Force realized the had a weak case and didn't want to try and prosecute me while having Mr. Capovilla on my defense team. The Air Force then decided to offer me and alternative disposition: Article 15, where I would plead guilty, waive my right to a board hearing and receive an Other Than Honorable discharge without a fight. Mr. Capovilla discussed with me all of the options, to include declining their offer and going to court martial instead, because he is a confident litigator. Ultimately, I asked that he try to negotiate a better Alternative disposition and he agreed. Rob is understanding and does not try to push you into doing something you're not comfortable with just so he can make more money. In the end, he was able to get to get the base legal office to offer me: Article 15 as a forum where I could try to prove my innocence, I had to waive my right to the discharge board, but if found guilty, the separation authority would then decide on my characterization statement. This was a much better offer and ultimate outcome than having to face a Courts-martial where a conviction ruins your life and you end up as a registered sex offender. I highly recommend Mr. Robert Capovilla.
