Not totally satisfied with the process, and although Mr. Berman is polite and professional, he'd ask me to resend important info

I hired Mr. Berman to handle my case for an auto collision my husband and I were in last August 2018. I worked 4 jobs and the paperwork that the insurance company was sending me was overwhelming on top of the shoulder and neck injury that I had. We hired him roughly 1 1/2 week after the accident. He ...seemed very professional and attentive so I was glad to be relieved of the burden of having to handle the claim by myself and just focus on getting better so that I could return to my jobs. He referred us to a chiropractor whom we went to for physical therapy for almost 2 months. In that time I would send emails to update Mr. Berman on what was going on with my jobs, physical therapy and any screenshots of my pay from two of my jobs (uber and amazon) prior to the accident as well as after, as he requested, so that we could track the loss of income. The pay stubs from my other two jobs I scanned and also gave in email along with a letter from one of my bosses stating when I would be allowed to return to work (after physical therapy). Things ran smoothly at this time. Once we finished physical therapy and I returned to work, we needed to progress forward with our claim and that's when things started to run less smoothly. There were a few occasions where I had sent emails with specific dates when I had returned to work to each job, but later Mr. Berman would ask me for the same information I had already sent. It happened on a few occasions and I started to get frustrated because I felt the emails I had sent with important information that he'd requested previously was just being overlooked or that rather than logging the info when I'd send it the first time he would just ask again when he was ready to use it. Once we gathered all of the paperwork he needed he remarked that there were still a few weeks left until our claim needed to be filed so he wanted to take that time to make sure he had everything, mind you, this was a little over 5 months since the accident so I couldn't understand how we needed to wait longer since I stopped my physical therapy 3 months beforehand. I knew part of the delay was the inability to get a letter from one of my managers but that was a 2 week delay tops as my managers gave me the runaround. I let it go, though I was still frustrated about having to repeat sending info. After he filed the claim it seemed like the only time I would get an update is if I wrote to check in after weeks would pass. We thought we would have had everything settled by April, but after talking to Mr. Berman in early April he informed us that it would be mid-May. We delayed a visit overseas to family and delayed moving into our new apartment because we didn't want to be overseas during the process and we also needed the funds to move when we return. After a few weeks and not hearing an update on our claim I emailed him to find out what's going on. At this time we're now staying with an Aunt and we're not wanting to rent a new place until we come back from overseas so we're needing to know when to expect things to be settled. This time he calls me and explains the end of May. We delayed our move twice already, and now we had to delay again. He explains that he's waiting on a quote from the insurance company, which I can understand isn't in his hands, so I wasn't upset about that. I was upset because he said no later than April originally and we planned our move and visit overseas to family around it. My husband also had to have a septoplasty while overseas, which the settlement was to cover. Once everything was settled and done we got our claim and settlement on June 15th and recieved our checks June 19th. It was 10 months from the time of the collision. Also, I'm still getting collection calls about the Medical Bill's that are supposed to be paid by the law office, so hopefully the collection companies stop calling soon. Between his fee and physical therapy/ medical bills I got $7.6k out of a $25k settlement.

Ms. Yigit- First off, I want to point out that this is the second two-star review that you and your husband, Tolga Yigit, have left relating to the same case. While the main concern you and Mr. Yigit had was addressed in my response to your first review, I wanted to take a minute to respond to the additional feedback that you left in this second review. After you completed treatment, I required additional information to corroborate and document your lost income claim in a manner which the insurance company would consider it. For example, while I had your pay stubs from Uber, I needed prior pay stubs, which you had not provided previously, to establish a prior baseline to quantify your loss of income with State Farm. I did also ask you to resend some photographs of documents that you took into a PDF or facsimile to present a more professional presentation for your claim. Most of these requests for new information came immediately after you stopped treatment for the first time. After about two months of treatment, you advised me that you were done with your treatment. I did recommend that we wait a couple weeks after your treatment ended to begin submitting a demand because sometimes my clients stop their treatment and then realize they are still having issues. This was explained to you, and you agreed with me. Meanwhile, I requested that your supervisors fill out and sign a one page lost income verification form. I explained that your paystubs would not be enough for State Farm to consider your lost income claim from two of your employers. It took several weeks for your employers to fill out the form, but once this was provided to me, your demand was submitted within a week and a half. Once your demand was submitted, we had a conversation about a potential timeline. I advised you that it can typically take up to 6-8 weeks to receive a response. You did mention that you and Tolga intended to take a trip, and were hoping to resolve the claim before you left. I did advise you that I would do my best to speed the process along, but that sometimes it can take a while to resolve an insurance claim. It did take longer than usual for State Farm to respond to our initial demand, but I frequently gave you updates through text message, phone calls and e-mails. In these communications, I explained your options, including filing a lawsuit, but you instructed me to continue waiting. In terms of the result, you sustained a soft tissue injury which resolved completely after 2-3 months of therapy. Your settlement was enough to resolve all your medical bills, attorney's fees, and left you with $7,600 for 2-3 months of pain and suffering. I advised you that this was a reasonable settlement under the facts of your case, and that your other option would be to file a lawsuit. One thing- your case was disbursed about two weeks ago, and all your medical bills were paid as outlined on your settlement accounting. If you receive another collections notice, but you shouldn't, please contact my office immediately so we can help you resolve the issue. As I stated in my response to your husband's review for the same case, I do not believe that I earned a two star review, but I understand that I cannot please anyone. I appreciate the opportunity to work with you, and wish you and Tolga the best.

I dont recommend

Why i gave 2 stars, from time of the accident to receive check was total 10 months 2 days. Also retainer agreement, his fee is 1/3 which is normal but his fee taken from gross settlement. There is a huge difference between net settlement to gross settlement. It made an extra 5k loss for us from settl...ement. There are many many law firms taking the fee from net settlement. I do not reccomend this firm because you can find another firm who is taking fee from the net settlement.

Mr. Yigit- I appreciate your feedback, but I am surprised by this review. When we met (on Labor Day), you specifically asked about whether my firm's fee was taken from the net recovery or the gross recovery. I was very clear about my firm's fee structure, and it was written in the retainer agreement. A contingency fee from the gross recovery is the industry standard for personal injury attorneys, and I disagree with your contention otherwise. In terms of the time it took to resolve your claim, after the accident, you treated for several months. After you had completed treatment, it took several weeks to obtain medical records. Large health care facilities process records requests in the order they are received, and sometimes the time it takes to receive records is out of our hands. Once we did receive your final records, a demand was submitted to the insurance company literally two days after we received the final records. After the demand is sent, it can sometimes take an insurance company a couple months to respond to the demand, and then we had to negotiate to get the highest settlement possible. Then I contacted every one of your health care providers to obtain a discount on the bill. Meanwhile, whenever you reached out to me for a status update (often times on my personal cell phone on weekends or after hours), I always immediately responded and provided you a status update advising you exactly where we were in the case. I don't believe that I earned a two star review, but I know that you cannot please everybody. Despite your review, I want to thank you for the opportunity to work on your case, and I wish you and Tarah the best.

Josh and everyone at his firm did an excellent job with my case. They looked at every angle and detail to ensure that I was being treated fairly by the state. Josh also fought to prove that I was not guilty until in my case rather than looking for the best deal as most lawyers seem to do. The firm is... not afraid to fight for you.
