Donald E. Haviland Jr.

Don Haviland began his career in class action and complex litigation under the tutelage of the late Herbert B. Newberg, the renowned class action scholar and author of the seminal treatise, Newberg on Class Actions. Before founding Haviland Hughes, Mr. Haviland enjoyed tremendous success as Lead Counsel in class action cases in state and federal courts. His experience as an expert in the field allowed him to take this skill to a whole new level of success - in founding Haviland Hughes.

Work for Clients

Mr. Haviland has successfully handled many complex trials and settlements resulting in multi-million and billion dollar awards. Among them were suits against the manufacturers and sellers of prescription drugs, concert tickets, computer, automotive and paper products, consumer goods, insurance, asbestos, explosives, as well as massive suits against the airline industry, the NASDAQ stock market, the drug industry and even the National Football League. He has successfully litigated novel, cutting-edge claims involving rights of subscribers of online gaming products and victims of identity theft, among others.

In addition, Mr. Haviland has been involved in numerous state court complex commercial litigations and class actions, including multi-state cases involving pricing and marketing of infant formula, hospital products, prescription drugs, and defective building products and consumer goods, among many others.

Education

Mr. Haviland received a B.A. from Rutgers College, Rutgers University in 1987, graduating magna cum laude. He received his juris doctor law degree from the Villanova University School of Law in 1992. Mr. Haviland is admitted to practice before the Supreme Court of Pennsylvania, the Supreme Court of New Jersey, the United States District Courts for the Eastern District of Pennsylvania, the District of New Jersey, and the Eastern District of Wisconsin, as well as the United States Courts of Appeals for the First, Third, Sixth and Ninth Circuits.

Recognition

With more than twenty years of concentration in the area of complex commercial and class action litigation, Mr. Haviland has been involved in cases of national importance. He has been selected as among "The Best Attorneys in Pennsylvania" by his legal peers in Pennsylvania for the years 2004, 2005, 2009, 2010, 2011, 2012, 2013, 2014, 2014, 2016, 2017 and 2018, and was voted one of "The Best Attorneys in New Jersey" by his legal peers in New Jersey in 2006. Such distinction is reserved for the top 5% of attorneys in a State.

Mr. Haviland's success in the courtroom has led to several important legal milestones over the years involving individual rights and protections including, for example, the right to sue professional sports leagues for collusion under the antitrust laws (Shaw v. Dallas Cowboys Football Club, et. al, 172 F.3d 299 (3d Cir. 1999)) and the right to recover in Pennsylvania for "unfair and deceptive practices" involving the marketing of pharmaceutical drugs (Commonwealth of Pennsylvania v. TAP Pharmaceutical Prods., Inc., et. el., 36 A.3d 1197 (Pa. Cmmwlth. 2011)).
