Five Stars

Back in the Fall of 2015 I was arrested for DWI first offense and pleaded not guilty. I was initially not offered and type of plea other than DWI and all the penalties that go along with that charge. About my fourth appearance at court before trial I was offered a violation charge of DWAI. I decided ...to go for it and I now know I hired the right lawyer to defend me.

Ed Fiandach and his team are fantastic!

I found myself in the unfortunate circumstances where I needed to hire a DWI attorney and I'm glad I chose Fiandach and Fiandach. Ed and his team were great at explaining the process, answering my questions, and keeping me informed throughout the process. During the pre-trial hearing the judge rule...d to suppress all evidence (basically dismissing the case) all due to strong work/performance of Ed's team member during the hearing). However, the DA appealed to the county court and, due to no fault of Ed or his team, my case was prolonged for over two years. Throughout the whole process, Ed and his team were very responsive, did all that they could to help me stay patient, and pushed through until the case was just finally dismissed! I'm fortunate that everything will be erased from my record so it won't effect my career or my family in the future. A very hard lesson to learn but I'm grateful that, because of the work of Ed and his team, I will not have a criminal record.

DWI- CONVICTED

I was pulled over one night and was charged with my first aggrevated DWI. My wife insisted that I hire Ed Fiandach. I had my initial consultation with him and that was the only time I saw Mr.Fiandach. I read all the reviews and decided to hire him as my counsel. The whole process took a year to settl...e. Mr. Fiandach did not represent me in any of my court appearances however his team of different attorneys were with me every time I had court. Plea deal of just a DWI was offered to me multiple times but I was determined to get a dismissal since I read multiple reviews online from different clients that Mr.Fiandach is a master in getting a case exactly like mine dismissed. I opted to take the case to trial instead of accepting a Plea deal because I was not settling for a DWI. I am hoping Mr.Fiandach shows up on this last day of judgement and the result is in my favor. A completely different attorney shows up who I have never seen or met before on my final day of judgement. We introduce each other and we go to trial. 2 hours later I walk out with a conviction of aggrevated DWI. Never heard or saw Mr.Fiandach since the day I initially consulted him and paid him in full for retaining him as my counel. I will say that his team of attorneys are very polite and cordial. Will I recommend the fiandach firm to anyone? I dont think so because I am a result driven individual and I had the pleasure of meeting his team and witnessing them perform in the courtroom except for Mr.Fiandach and for that reason I doubt the integrity of all the positive reviews that are listed all over the internet.

Unfortunately, although we always do our very best, we cannot guarantee nor do we always succeed at trial, especially in cases such as this where there is a very high BAC. This individual fails to point out that at his request, I met with the prosecutor and the Judge to negotiate a plea to a reduced charge and I was able to obtain the same. That is the “plea deal” that the client refers to. Once we obtained the favorable plea bargain, the client changed his mind and decided that he wanted instead to go to trial. He was cautioned that his BAC was extremely high and that he faced a high probability of conviction on the top count. Our absolute policy is never coercing a client to accept a plea bargain. It is our policy, as it should be, that the client must make the decision as to whether or not to go to trial. Our advice notwithstanding, the client nevertheless insisted upon a trial and the results are as he set forth. I wish him luck in the future. Ed Fiandach

IF YOU WANT RESULTS...HIRE FIANDACH

This past July I found myself in a situation I never thought I'd be in again. Let me start by saying in my early 20's I got two dwi's back in the early 90s. I never considered myself a heavy drinker, but definitely a irresponsible person when it came to that back in the day. Almost 20 years later, I ...am in my early 40s. I have a successful business and a family. A high school friend of mine called me up to meet for a drink who I hadn't seen in about 3 years. After leaving I sped up a little to early from a 30 to 55mph change and I again found myself in a position I never thought would happen again. I refused sobriety tests and breathalyzer and was arrested. This is when I found out about new NY laws, the 3 in 25 years. I was facing not driving for up to 5 years and possibly jail time. This is when I made the best decision hiring Ed Fiandach. When you refuse a breathalyzer, you have two court cases going. Your criminal court and your NYS DMV refusal hearing. First was the refusal hearing...the officer didn't show up and Fiandach was able to get my license restored while I was going through court. Then the criminal court, after many months of court we decided to take on a bench trial. Fiandach again came through and as a result I was charged with an ability impaired instead of a DWI. We still had one more huge hurdle to overcome(and they got over everyone we needed). The DMV refusal hearing. Even though I was found guilty of an impaired in court and could get my license back in 90 days, The DMV could still take it for 5 years. The last DMV refusal hearing was finally scheduled and we went in and Terence McCarty from Fiandach beat it, proving to the judge the officer didn't have probable cause to arrest me. I was astounded with the results. I was facing up to 5 years not driving and possibly jail time. I received an ability impaired and was able to drive most of the time throughout the process and full license back shortly after all court cases were complete. I had min. fines and no classes. If your worried about costs, spend them here because if you don't it will end up costing you a lot more down the road in fees and fines and classes. These guys truly are the best at what they do. I can't say enough

Made the Right Choice

I couldn't believe it. Today was my first appearance in court and the Judge asked Mr. Fiandach for advice on someone elses' case. Yes advice on another person's case. The other man was represented by another lawyer and there was a question about the law. The Judge commented about not having Mr. ...Fiandach's book with him then asked Mr. Fiandach where the answer would be found. When he told him, the Judge asked him what the answer was and Mr. Fiandach told the court what the law was! Yup, I made the right choice.

Avvo Rating

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.

What determines Avvo Rating?
  • Experience & background Years licensed, work experience, education
  • Legal community recognition Peer endorsements, associations, awards
  • Legal thought leadership Publications, speaking engagements
  • Discipline Disciplinary information may not be comprehensive, or updated. We recommend that you always check a lawyer's disciplinary status with their respective state bar association before hiring them.
