Excellent Representation

Low level office staff

I contacted this office the day after my arrest. I met with Ed himself who assured me he would personally representing me. I was reassured that I was choosing the best option for circumstance. He recommended I have an alcohol evaluation done because the judge will want one and I will look good gettin...g it done early. At my first court appearance a man walked up asking my name & said he’s representing me today. He had my “file” and didn’t need any imformation from he said. The judge ordered intake an evaluation for next appearance. I was frustrated because the result of the one I just had was in my “file.” The DA and judge didn’t have it. Now the next appearance comes and its some different guy representing me. I actually see him almost every time after that. We rarely communicate and I’m just greatful I have my mother with me every time. Ow we get towards the end of things. The court interviews the trooper who pulled me over and I’m found guilty. Of course my lawyer, the DA and the judge are very friendly with and enjoy catching up with the trooper. He’s a friend to all apparently. So of course I’m found guilty. I’m ordered to attend a driver impact panel, take the DDP classes and to pay court fines and dmv costs. The judge and my lawyer assure me at that time that if I complete everything I shouldn’t even have to appear for the last date of compliance. I complete everything, except the DDP class as I was only in class 3 of 7. It took weeks for the dmv to get court paperwork to sign up for the class and the classes usually have monthly sign ups. So this was not by any fault of mine, as this compliance date was about 6 weeks out. A week prior to this date I called and spoke with Cassandra and explained that everything was completed except my completion of the DDP classes. She said she had to get back to me because there were no lawyers in the office. Okay, I called back that Friday, 2 days later. It was Cassandra again. She seemed to have an attitude or frustration that was calling again. She explained that there no lawyers in still and Monday was going to be a holiday, Labor Day so people were out. She would try to get answer by end of day. So Tuesday comes, my court date is Wednesday and my little preschooler’s first day of school ever. I was so excited and so was he that I bring him that first day. My court date for compliance is weighing on my mind though as it’s at 9am and I was getting anxious! I call Tuesday now, as they couldn’t help me Monday due to the holiday. Of course I get Cassandra. I’m frustrated now as she doesn’t have an answer from a lawyer still! She talks down to me and tells me I should have known I had court and had to appear and shouldn’t be upset because it’s what happens when I’m involved in something like this. If you could have seen my jaw drop! I’m so angry now and demand to talk to a lawyer or supervisor. She gets condescending and reply’s with things like I’d be so happy to do that for you and I hope your day gets better mam. I wanted to drive down there so she could look me in the face as she was speaking to me that way! I get Sue now. I explain how pissed I am and especially with Cassandra. Sue explains that Cassandra is new and should have taken care of everything the week proline but didn’t know that. Sue asked for an email with all of my paid receipts and notice I was enrolled in my class. She said the lawyer would represent me and I wouldn’t have to come to court that be t day. I thanked Sue and was feeling somewhat relieved. So of course nobody calls me after court or all week. I just wait for my documents to come in the mail. Saturday they come. It says that the judge has ordered another evaluation and a mandatory court appearance from me in 4 weeks! I’m beyond anger, frustration, sadness. Each evaluation costs me $200. Plus I thought I already complied and was sentenced & it’s less than 9 months since my last one.. I get it done & no lawyer shows up on my court date! My mom talks to Cassan

First, I would like to clarify and correct that you were charged with the crime of DWI, however, after a bench trial, you were found NOT GUILTY of that crime as well as the 3 traffic violations you were also charged with. You were found guilty of DWAI, which is a violation of the traffic law and not a criminal offense. Second, you did not hire me as your exclusive attorney, you hired my team which consists of three former felony prosecutors and myself. Third, as far as paperwork filed with DMV, that comes directly from the court and we have no control over when it is filed and when DMV takes action on it. Fourth, when we appeared on your behalf for your compliance, the judge wanted an updated evaluation and did adjourn the case to a later date. It is not our practice to phone clients after court appearances to let them know what happened. It is our practice to do so by means of written correspondence, which we did, by your own admission. If you were curious about what occurred, nothing prevented you from phoning our office. As for the judge requiring an additional and/or updated evaluation, that is at the judge's discretion. We did, however, point out that you had a good evaluation initially which the judge was in possession of. In the end, you avoided a criminal conviction and the ramifications of the three underlying traffic charges, and we are continuing to work with you to resolve your outstanding issues with the court.

Felony Aggrrvated DWI

Back in May of 2015 I got charged with a felony DWI. Embarrassed and ashamed of myself I knew I needed one heck of a good lawyer that was very experienced in DWI'S. I couldn't be happier in that I retained Fiandach & Fiandach to represent me. It's been almost a year and I'm still fighting my case wit...h ease knowing Ed and his team are the best lawyers possible. I've seen an actual bench trial while I was awaiting and Mr. Rath tore apart the officer as the court room was literally laughing at the arresting officer. They have been open and honest every step of the way and never for a minute did they make me feel less of a person for my poor decision to drink and drive. They have given me the upmost respect and are very professional. They are friendly, on time and ready at every single court appearance thus far. Thank-you Ed

When I was in the custody of the police after my arrest, I told them that I wanted to talk to a lawyer before I made up my mind because I am a school teacher. I tried several numbers, but either they weren't there or they wanted a credit card. The officer said "Fiandach always answers" and he was ri...ght. At 3:30 in the morning, Ed painstakingly went through my situation and condition and even spoke with the officer. After I was released, I contacted the Fiandach office, spoke with a nice woman named Sue and was given an immediate appointment with Ed. For the next four months we were a team. Ed and his associates were always on time for court and it was obvious to me that they knew their way through the system. On the day of my trial I was terrified, but Ed's friendly manner mellowed me out. In the end, we got what Ed hoped we'd get and I kept my job and my sanity. Thank you Ed and everyone at Fiandach & Fiandach.

Samantha raises a point lost to many. In New York, a motorist who is asked to submit to a chemical test (this will be the one at the police station, not the preliminary breath test at the scene), has a right to consult with counsel prior to making a decision. The decision to take or not take a test is vitally important and is best made by counsel. In the event that a motorist is denied the right to consult with counsel, either the test or a refusal that follows may be subject to suppression. - Ed Fiandach

DWI- CONVICTED

I was pulled over one night and was charged with my first aggrevated DWI. My wife insisted that I hire Ed Fiandach. I had my initial consultation with him and that was the only time I saw Mr.Fiandach. I read all the reviews and decided to hire him as my counsel. The whole process took a year to settl...e. Mr. Fiandach did not represent me in any of my court appearances however his team of different attorneys were with me every time I had court. Plea deal of just a DWI was offered to me multiple times but I was determined to get a dismissal since I read multiple reviews online from different clients that Mr.Fiandach is a master in getting a case exactly like mine dismissed. I opted to take the case to trial instead of accepting a Plea deal because I was not settling for a DWI. I am hoping Mr.Fiandach shows up on this last day of judgement and the result is in my favor. A completely different attorney shows up who I have never seen or met before on my final day of judgement. We introduce each other and we go to trial. 2 hours later I walk out with a conviction of aggrevated DWI. Never heard or saw Mr.Fiandach since the day I initially consulted him and paid him in full for retaining him as my counel. I will say that his team of attorneys are very polite and cordial. Will I recommend the fiandach firm to anyone? I dont think so because I am a result driven individual and I had the pleasure of meeting his team and witnessing them perform in the courtroom except for Mr.Fiandach and for that reason I doubt the integrity of all the positive reviews that are listed all over the internet.

Unfortunately, although we always do our very best, we cannot guarantee nor do we always succeed at trial, especially in cases such as this where there is a very high BAC. This individual fails to point out that at his request, I met with the prosecutor and the Judge to negotiate a plea to a reduced charge and I was able to obtain the same. That is the “plea deal” that the client refers to. Once we obtained the favorable plea bargain, the client changed his mind and decided that he wanted instead to go to trial. He was cautioned that his BAC was extremely high and that he faced a high probability of conviction on the top count. Our absolute policy is never coercing a client to accept a plea bargain. It is our policy, as it should be, that the client must make the decision as to whether or not to go to trial. Our advice notwithstanding, the client nevertheless insisted upon a trial and the results are as he set forth. I wish him luck in the future. Ed Fiandach
