Individuals seeking to make things easier on their families after their death, preserve their wealth, pass down a family business, or maximize the value of their business need intelligent planning that reflects in-depth knowledge of business, tax and estate law.

    Disputes often arise in the administration of a trust or estate. I represent beneficiaries and fiduciaries (executors/trustees) to help sort out these matters.

    I represent executors, trustees, and beneficiaries, in connection with estate administration matters, including Surrogate’s Court filings, tax filings, and estate and trust litigation.

    Revocable and Irrevocable Trusts, including Medicaid Trusts, Charitable Trusts, Life Insurance Trusts, Supplemental Needs Trusts, Grandchild's Education Trusts, GRATs, QPRTs. Wealth Preservation often involves the establishment and management of trusts, the creation and transformation of entities holding business or investment assets, and the transfer of interests in these entities in tax-favored ways for the benefit of current and future generations.

    I help my clients navigate the myriad issues surrounding elder law. It is important to work with an attorney as you anticipate your future needs, or the needs of elderly relatives. This includes estate planning, elder care coordination, and estate or trust administration.

I am a native of the Rocky Mountains, having grown up in Evergreen, Colorado.  Since settling in New York, I have developed a broad and sophisticated client base. I concentrate my practice in the areas of estate planning, trust and estate administration, and estate and gift taxation.

It is important to me to consider each of my client’s values and background as I help them decide which type of estate plan will best fit their needs.  I use a practical approach to my practice.

Offering the assurance of complete confidentiality and responsive service, I try to put each client’s mind to rest on all matters relating to trusts and estates law, as we work together to create a comprehensive, strategic and highly-personalized plan that addresses their goals and wishes.

Knowing that it is not always easy to come to an attorney’s office, I am available for home, office, and hospital visits.

I can assist you with:

  • Wills and Trusts:  Whether you have a large estate or relatively few assets, someone will have to address the distribution of those assets in the future. That process is never simple, but without proper planning—which includes taxes, family issues, beneficiary designations, and more—it can turn into a complicated web of problems for your heirs.
  • Powers of Attorney:  This is what I refer to as the "golden estate planning document".  Each person over the age of 18 should have a property drafted Power of Attorney in place.
  • End-of-life decision making:  I often assist my clients in navigating their end-of-life choices.  When possible, many individuals want some sort of control over their final moments.  I can help ease your mind and simplify your options for you.
  • Probate and Estate Administration:  I will carefully guide you through the probate process, and can help you with gift and other tax returns, the transfers and funding of testamentary dispositions, and any probate litigation you might face.
  • Estate Litigation:  I represent clients in will contests, sometimes in support of a propounded will and on other occasions to object to a will. I also participate in proceedings to: construe and reform wills, in contested accounting proceedings and in tax proceedings, to determine spousal rights, and to analyze the validity of prenuptial and antenuptial agreements, as well as fiduciary litigation to challenge the actions of an executor or trustee in managing the financial affairs of the estate or trust.
  • Digital Assets:  I help my clients decide how to manage and dispose of their digital assets.  Examples may include: online photo storage, social media sites, business records, and other online or digitally stored content.
  • Concierge Legal Services:  I frequently assist clients who do not have family members or friends they can comfortably rely on to assist them.  For those clients, additional legal assistance may be required, such as more focused legal services and life management assistance.  In certain circumstances, I act as trustee and/or executor for my clients, as well as agent under a power of attorney or health care proxy.

Extremely Knowledgable
I contacted Emily after reading her reviews and within a few minutes of talking to her I knew I had made the right choice. The situation was regarding my 86 year old aunt whom I had power of attorney over. She had been hospitalized with dementia for nearly three months and wasn't going home. There are all kinds of rules to play by when dealing with life savings, property, Medicare, Medicaid etc. Emily explained everything in detail. She gave me all my options and answered all my questions. I did not enlist her services, only because she said I didn't need them. That's honesty. She was caring and compassionate. If you need a lawyer in her field I cannot recommend her enough.

An excellent and knowledgeable person
I live some 1500 miles away from Emilee Lawson Hatch. Never met her in person. Discover her on the internet. Her profile stood out from the others. I needed a probate lawyer in New York state to represent me. And that she did. I talked to her on the phone two times. The rest of the times we mainly communicated via emails. There were times when I would email her two three times a day. Her spontaneously response amazed me each and every time. If I had a question after five o’clock CST my time, and sent her an email, the next morning I had my answer waiting on me. She made me feel like I was her only client. Her firm, Bousquet Holstein is very fortunate in having a lawyer of her excellent caliber representing their firm.

Probate from...
Ms. Hatch provided solid legal work on our case. When we presented options, she would intently listen to our what we had to say. And she would provide scenarios as to how things could play ou in Court. This all based on her last work experience. Ms. Hatch has a working knowledge of Estate work. Whenever a hiccup occurred Ms. Hatch was able to put us back on track. At one point we were contemplating a Partition & our case was handed over to another attorney who specializes in such cases. However, we lost traction & felt put on the back burner. We asked for Ms. Hatch back and she settled the Estate within our proposed timeline. We highly recommend Ms. Lawson-Hatch to anyone struggling through Estate/ Probate Cases.

Personable, Professional, Competent
When our Estate Lawyer retired, we solicited recommendations and researched Estate/Trust lawyers in the Syracuse area. Emiliee K. Lawson Hatch’s profile stood out among her peers, and upon talking to and eventually meeting her, we found Emilee personable, professional and competent in Estate Law. She was a good listener and an organized detail person. She welcomed questions and explained complex legal issues, in layman’s terms. When it became apparent that our original trusts needed major revision, we were able to work back and forth by email and occasional phone conversations to complete the process. Greatly Satisfied
Emilee Hatch is a bright, caring, and energetic attorney. I had originally sought her out to write a will to include a pet trust, and to advise me on tax issues.However, due to the death of my sister from cancer, as my only remaining family member, as well as an emergency hospitalization that left me homebound, I also had the need for someone who would make hospital and home visits, and to assist me with end- of- life decisions. WTC 911 SNT Beneficiary
I hired Emily because she stood out on the service. Two trustees denied me any and all benefit of the trust. I was billed over $1,700 for a one-hour conversation with the current trustee. I received copies of 15 bank statements. My purpose hiring herwas to have the trust dissolved. She spent more time trying sell auditing services than she did trying to have the trust dissolved. At 63 in poor health with cancer. I requested her to have fund managers move the money out of high risk profile considering covid-19 presented unprecedented issues in the market. She was quick to email at $360 an hour and accomplished little to nothing.
