Horrible attorney

When I bought my first home, I hired Marc Miller to be my attorney. The crooked seller did the final walk-through with me before closing. My buyer's agent/realtor with Blue Moon Realty (in High Falls, NY) should've been there, but she chickened out because it was raining. She made sure to show up at ...the closing later that morning to get paid, that's for sure. During the walk-through, the seller quickly turned on and off the thermostat; just long enough for me to hear the heat kick on. Then she turned the thermostat back off quickly, saying something about conserving fuel. Convinced that there were no problems, I went to the closing. Afterwards, I returned to my new house, and turned up the thermostat. Huge plumes of black smoke and carbon monoxide came out of the vents. The heat exchanger had broken. I had to suddenly had to come up with $6,500 for a new furnace - after spending nearly everything that I had to buy the house. I called my real Marc. He wasn't in the office so I left a message. Marc blew me off and wouldn't return calls or emails for two weeks. I finally called again and got him on the phone. He told me that because I didn't "catch" the furnace problem at the home inspection, or during the final walk-through, that it was "my red wagon", as he put it. The seller had fraudulently covered up the problem, and my home inspection had been done two weeks prior, when there wasn't a problem (yet) with the furnace. Marc Miller lied online and said that I never was his client, he's full of it. He doesn't care because he got this money at the closing and doesn't want anyone to know that he screwed me over. There was plenty that he could've done to have my back. He completely blew me off and dismissed me. It turns out that Marc has a poor reputation among the locals. He cares about closing the deal and making a fast buck, that’s all.

A purchaser, buying a pre-existing home must rely on their building inspector to determine the physical condition of the property & its systems. I cant just get a new furnace for a client after closing. There is no warranty by a seller, except for new homes. If the inspector was negligent, they may have a claim against their inspector. There is no claim against a seller for later failures or defects discovered unless there was fraud. I understand the buyers frustration. A furnace failing a short time after closing is not a great way to begin home ownership. I advised them correctly & accordingly. I did not blow them off, but it was not what they wanted to hear... They wanted a new furnace and there was no way I could get them one under these circumstances.
