Jason Lowell Shaw

I have worked in the insurance business for many years and experienced working with a multitude of attorneys. But, on a matter relating to my family, I've had the extreme pleasure of working with Jason Shaw for the preceding 2 years. Mr. Shaw's level of knowledge, professionalism and proficiency is... only surpassed by his level of ethics, warmth and real personal interaction with his clients. His demeanor in the professional setting is of the highest level, yet his mannerism in his interactions with his clients is one of caring, concern, sincere counsel and just plain wonderful humanity. I cannot say enough about this excellent example of what a genuine legal counselor really is. It has been a wonderful experience to work with a real counselor, in every sense of the word.

Jason represented our group which opposed a proposed industrial scale gravel mine in our residential neighborhood. Mining was allowed with a special use permit. This required extensive review of many documents, familiarity with zoning and mining law, and attendance at Planning Board and Town Board... meetings. Jason spoke extemporaneously at these meetings and cogently put forward our position. His expertise was instrumental in convincing the town board to establish a moratorium on new mining applications which led to the town revising its zoning to prohibit new mines in the residential areas of town.

My wife and I were forced to sue our insurance company after we experienced an accidental oil spill in our basement (estimated at over 300 gallons) that unfortunately seeped thru a crack in the floor into the soil and groundwater under the basement. We immediately notified the NYS DEC and our insura...nce company. The NYSDEC required us to provide an investigation and remediation plan and schedule as a potentially responsible party. After conducting an investigation, our insurance company declined to provide third party liability coverage despite a finding during the excavation of contaminated soil that the groundwater, owned by the NYS DEC, had also been contaminated. We interviewed various litigators and hired Mr. Shaw to represent us in a lawsuit in federal court against the insurance company. The insurance company hired a New York law firm and the lawsuit began with an exchange of documents, interrogatories and scheduled depositions. Mr. Shaw proved quite competent in understanding the issues and representing our interests in the lawsuit. He was our interface with the court and the insurer's law firm and showed that he clearly understood the case and the underlying case law that would determine the outcome of our case. He was very available to us in explaining the legal process, the pros and cons of our position and what the expected outcome of various steps that were taken. I am an engineer by background, have been involved in environmental projects similar to ours and also in complex contract negotiations. As a result, I was very involved in the progress of the lawsuit with strong opinions about some of the issues. I found Mr. Shaw to be very patient in explaining the process and the issues to me and did not appear to be annoyed at my numerous contacts with questions and advice. Overall, I found him to be a very competent lawyer and we were very pleased with the eventual outcome.

Mr. Shaw was successful in defending my firm against a potentially costly lawsuit. My clients sued for breach of contract based on my alleged failure to complete design work in a timely manner. Mr. Shaw was excellent in helping me to understand and prepare for the case, leading me carefully through... deposition, which was new and very intimidating to me, and then taking the case sucessfully through appeal.
