Dear Anonymous, I felt compelled to reply to your recent posting concerning legal services that I rendered on your behalf. Unfortunately, because your identity is unknown to me, I cannot specifically address your complaints. Because I personally concentrate in two areas of the law, personal injury and criminal defense, I can only assume it was the latter since all of our personal injury cases are handled on a contingency fee basis. It is important to note that there are a number of occasions when individuals are charged with criminal or quasi- criminal offenses for which the attorney must give practical advice as to what is in the best interest of the client. Sometimes, there are legitimate defenses to be raised that would result in an acquittal of the underlying charges. There are other instances, however, in which it would be counterproductive to try a case when there is no reasonable prospect of an acquittal. When it comes to sentencing of individuals, the judge takes into account such factors as whether the individual acknowledges his or her wrongdoing, takes steps to become a productive member of society and commits to a law-abiding life. Response from Joseph J. Hoffman, Jr. Autumn: I just wanted to reply to your recent post. First and foremost, let me just say that I was extremely happy that the charges were dismissed. As I advised you when we met, the charges that you were facing called for a potential lengthy state prison term, and even if we were to reduce our fee down to $6,000.00, based on your financial situation, I thought you would be best served by retaining a public defender. I said that because, assuming the prosecutor and the judge were to believe you, then the charges would, in fact, be dismissed and there would be no reason for you to incur counsel fees that you were not in the position to afford. It is for this reason that I advised you that in this particular instance you would be best served to stay with the public defender.
