Avoid at All Costs

I had a deeply troubling experience with Ms. Morgan at Fendrick and Morgan regarding my mother's estate planning. The firm prepared (or revised) a new will that removed me as a beneficiary, leaving my sister as the sole heir to my mother's (and deceased father’s) assets. However, the Burlington Count...y Court ultimately declared this will prepared by Fendrick and Morgan to be invalid due to undue influence. The heartbreak and betrayal me and my family felt was enormous when I learned Ms. Morgan revised my dying mother's will to completely cut me out, leaving everything to my sister as the sole beneficiary. This wasn't just a legal document; it was the final expression of my mother's wishes for her two children and the assets represented a lifetime of hard work and sacrifice from my mother and father. Key circumstances included: 1. The new will was drafted a mere 9 days before my frail mother passed away, while she was in hospice care on her deathbed. 2. She was heavily medicated with drugs like morphine, barely lucid, yet somehow deemed capable of making such a drastic, life-altering decision. 3. Ms. Morgan said the will was revised based on an unsubstantiated and false allegation from my sister (the sole beneficiary under the new will), claiming I had forcibly entered my mother's home, assaulted an aide, and removed by police; an incident that could have been easily disproven with public police records. 4. My sister was physically present in the room during the signing of the will; an obvious source of pressure and influence—in clear violation of the safeguards meant to protect vulnerable people making wills. 5. A member of the firm (specifically Ms. Van Buskirk) notarized a document without having personally witnessed the signature. 6. Another local attorney had previously declined to make these changes to the existing will after reviewing the situation, yet Fendrick and Morgan proceeded. In my view, these actions reflect poor judgment and raise serious ethical questions about prioritizing one family member's interests over the testator's true intentions and well-established prior wishes. My parents worked hard their entire lives to provide equitably for both children, and this attempted change undermined that. Based on this experience, I strongly recommend avoiding Fendrick and Morgan. I stand firmly by my account and any response from Ms. Morgan attempting to justify these issues would likely lack credibility.
