Seth Malkin

We shopped around because we heard that there were so many lawyers who call themselves "accident lawyers". We are so glad we chose Seth Malkin. He was the most caring and always available to us. During our case, we could have accepted the insurance company's very large settlement offer -- but Seth re...commended we should go all the way -- and he fought very hard for our rights. He was right. We eventually received TWICE the money than if we had mistakenly chosen one of those other injury lawyers! We are so pleased ---and Seth was so wonderful. We sincerely recommend him to everybody who needs an accident attorney.

I had a car accident a few years ago and Mr. Malkin was referred to me through a friend. It was my first car accident, I had no idea how the process worked to initiate a case against the person who hit my car and fled the scene. Mr. Malkin took his time in explaining each detail and steps involved.... He explained how my insurance would cover the accident since it was an unknown driver. I was nervous and confused because I thought my rates would increase. I then I started to receive numerous letters from my insurance company and was feeling overwhelmed. I decided to walk into his office, without an appointment, and his staff explained that he was in a conference but would stop the conference to meet me. Although, I was ready to sit and wait, he quickly stepped out of the conference and patiently explained to help me understand what all the documents meant. Initially when we met, he said he is always available to meet and speak to me. Due to my work schedule, I was not available to speak to him until after 5 o'clock, and he always returned my calls no matter what time. He really made it his priority to address all my concerns and I felt confident he would handle my case successfully. I had a terrific outcome and since that experience, have highly recommended him to all my friends and family. He is definitely my lawyer! His clients are his priority.

I had pending litigation for 4 years so dealt with mr Malkin and his office for a long period of time. While the staff was friendly, no one was very helpful. Every time I wanted to ask my attorney a question I was put on the phone with his paralegal instead who never knew the answer to my questions. ...Mr. Malkin was not forthcoming with information regarding court/judge meetings, opposing council meetings, he basically left it up to me to ask. If I wasn't as pro-active as I am I don't know what he would have ever told us. The biggest problem was he didn't tell us a lot of important factors. Who will be paying for what of it goes to trial, that even though he had dr reports for almost a year before we finally were going to trial, he thought they were bad and the doctors weren't as well versed in court as the opposing council doctors. Had he said that earlier, I could have always gone to another dr, but at the point he said that it was 1 week until court ( he failed to tell us that ad well) which gave me no time to do anything about it. Throughout the 4 years he continuously claimed he was on our side and would fight for us. He also loved to give examples about clients who didn't actually deserve what they were awarded in court. Well, I guess he didn't think how that made me feel considering how severe and life damaging my situation was and the effects it had and will have for the rest of my life. I offered information on my condition from my doctors so that maybe he could be informed of what he was discussing or reading from opposing councils doctors, he had no interest. He claimed he represented ppl in my situation before, yet you could tell when he spoke he didn't know much about it and multiple times even said the name of a complete different condition. Talk about insulting. He kept saying he was ready for trial, but he was sure it would be settled before it got that far. When settlement talks didn't go out way he acted like the numbers they were giving were absurd. When we actually went into to begin the settlement talk ( we found out are trial date was the following Monday) we didn't even know where he stood. He talked to us for an hour prior the day before which I had to request. We didn't accept and opted for trial. First day of court he was sure more would be offered so it wouldn't go that far. I wanted to go to trial but understood how tricky it could be since opposing council doctors tried to negate my doctors reports. After keeping us out of the loop for most of the vibrations he was having as well as saying we could talk to the judge and then coming back to say we didn't need to, he was sweating profusely and looking quite anxious and being consistently rude when my husband and I tried to get answers on questions of what was happening. He basically tucked his tail between his legs when I asked if we had a good chance if we went to trial and his response was " if I thought that I wouldn't be taking to you right now" talking to me as if I were a child. At that point I knew we had chosen the wrong lawyer, he didn't care about fighting for us, he was not someone I wanted in the court room with me because any confidence I had left in him was gone at that point. Had he not said that I had planned to go trial and take my chances, so I took a terrible settlement simply because I had not confidence in Mr. Malkin in the court room, not because I was scared, but because he obviously was. If I could figure out a way to sue him, I would. At the time to collect the settlement they have ms he check. Without giving a rundown of what they took out of that (really shady). It took multiple calls to get that and they couldn't understand why I wanted it. They had a $4800 lean with my insurance in which most was not case related, I had to call myself and got it dropped. They really only cared about their portion which they didn't earn. I did dr follow ups, calls for reports, testimony follow up calls b/c they had no follow through.
