Do not recommend

I went from having emergency custody of my children to have supervised visitation because Attorney Wing was falling asleep in his chair continuously going in and out of the room Family Relations placed me in. When hiring a new lawyer they simply said "well why didn't you go and wait in the court room...?" Well that would have been a great option had I knew it was one. One which my current representation should have said to me. Instead my children's father ran unopposed and was able to gain SOLE custody of our 2 young children, due to the direct negligence of Attorney Wing, in correlation with the family relations department. I have heard great things about attorney Wing up until about 3 years ago where I have heard there was something that resulted in some medical issues that may result in some issues with his direct representation in court. I am sorry to say I can not give a good recommendation and to top all that off was grossly over charged. As well as caused many many more thousands of dollars in attorneys fees to regain custody of my children thanks to the direct actions of this attorney. Please look elsewhere for representation.

Heartless And Absent

Horrible. Hired this man's "firm" to represent me in a simple divorce. His retainer was more than most and I had to borrow money from my grandmother who has cancer, but we paid gladly to have his experience on my side. Boy was I wrong. He doesn't return emails. His paralegal is rude and condesce...nding at times. Major details of the case had to be gone over numerous times at my expense. Eventually he got sick for 3 months and in all that time I got one strange call from his cell phone asking me to email a different email. I had sent probably 10 emails asking for updates in that time and not one response. But guess what, he sure billed me to read each one at HIS rate of $425 an hour where prior most emails like that were handled by his paralegal. By the time trial was coming up we had continued the case for about a year because of his "health issues" and had used up almost all of the hefty retainer on emails and one pretrial appearance. I fired him a month before the trial because I had unfortunate work circumstances and couldn't afford another retainer. Come to find out the opposing attorney had sent numerous documents to him and he never relayed anything to me. The file he sent me was incomplete and missing key evidence. No indication of investigating any of the major points I brought up. I ended up flying in to represent myself and got totally shredded by the opposing attorney. They set up lies and I couldn't respond and had no time to counter argue anything. And I've never argued in court before so didn't know how to handle any of it. The opposing party spent the entire time Wing was missing building a beautiful story against me. And wing just blew me off that whole time. Now I'm going to be paying out more than I can afford to my ex wife and have been accused of lies that are now court record. Mr. Wing is a heartless man who takes people's money and then disappears, and if he does appear he's unprepared. His actions have forced me to consider filing bankruptcy, rehoming my dog and moving in with my relatives. Hiring Mr Wing hurt my situation way more than if I had study law myself for a year and prepared my own defense.

Custody Modification

In Nov 2011, my ex-wife and I were divorced of which we had a baby together. The last 5 years involved petty behaviors, police involvement, an attempt to give up custody on two occasions and ultimately two false allegation claims of abuse. I will focus on the most recent incident of abuse allegations... as this is where Attorney Wing assisted me. It began Jan 2015; my son was 5 years old. I had had our son for the holidays and per the parenting schedule was due to bring him home that Sunday evening, ready for bed. My ex-wife demanded that I bring him home early in the day so she could spend time with him and get him ready for bed. I opted to bring him home between 6 and 7. The next day, she withheld him from school but I was not aware of this yet. That Tues, I received a call from DCF saying that allegations of abuse were being made. DCF came to my home that evening. The allegations were so disturbing and outlandish (my ex-wife was accusing myself, my step-son who was 6 and my wife) that even DCF had a hard time believing them. Regardless, I was advised to leave my place of residence as I was not allowed to be near my step-son, who was 6 at the time. All visitation with my son ceased at that time. All of this was followed by a 6 hour interview with police, two restraining order hearings (ex-wife began sending disturbing text messages to myself and my wife & contacting family members to tell them about the alleged abuse), a forensic interview for both my son and step-son and a full DCF investigation. My son made allegations during the forensic interview (I was not present) however it was determined by all present he was coached. My step-son was also subject to the same interview of which it was determined no said abuse ever occurred. At this time, we had another attorney of which we determined that the severity of this case far exceeded her experience and reached out to Attorney Wing. At this time, DCF closed their case but my ex-wife told DCF she would still refuse to let me see our son. In turn, I made arrangements with the school to have lunch with our son once a week. We met with Attorney Wing about a week before having to attend court for a motion filed for the previous attorney for contempt (interfering with parenting time) and to modify custody. From the moment we met with Attorney Wing, he set forth realistic expectations regarding modifying custody. After our first court date with him, April 2015 (I had not seen my son for custody visits in 4 months), the judge ordered custody to resume, changing pick up times to be at the school to alleviate hostile exchanges as well as giving me an additional day during the week. The next day, my ex-wife withheld our son from school so I could not pick him up. Attorney Wing raced to meet me at the courthouse to file an ex-parte motion and while it was denied, this action represents the actions of Attorney Wing throughout the course of this case. He never stopped fighting for my son who experienced so much more than he should have had to endure during the course of this custody battle. Between attending court, communicating with my ex’s attorney and the GAL, filing motions and meeting with my wife and I, Jim Wing never stopped fighting for our family; most importantly my son. Attorney Wing’s familiarity with our case, knowledge of family law as well as his overall experience alleviated many incidents of concern and anxiety over the behavior of my ex-wife. Attorney Wing told us from the beginning that custody changes are incremental and the results of the trial was exactly that-I was awarded 54% custody and her 46% custody with me having final decision making authority (swap in the custody plan), which as a father I feel is a huge change in custody. The complexity of my case leads me to highly recommend Attorney Wing’s due to his handling of this case and overall success. I feel this strongly speaks to his integrity and skill as a family attorney and highly recommend him.

JAMES WING IS A NIGHTMARE

In 7 weeks James Wing went through 10,000 of my divorce retainer and accomplished absolutely nothing. His communication skills are pitiful, does not return phone calls to his office("staffed" by one part time uninformed assistant), his cell phone does not accept messages. He charges fifteen cents for... each page of copy(!). time and one half for "after hours" calls and emails, arrives at court without prior meeting or conversation with client and basically, "wings"it. He has a litany of excuses for being uninformed: away for the weekend, had the flu. He indulges in personal criticism of client "too emotional" but is soft on the opposition! Boastful and arrogant, he eats up time with tales of his legal victories and will discuss at length and tedium every case but yours. Hiring James Wing was a bigger mistake than marrying my husband.

It is an unfortunate consequence of a large and long standing practice that sometimes we are chosen by and accept a client with whom we are not compatible. Happily, it is rare that one of our clients becomes as dissatisfied as the client who wrote this and therefore it was easy to deduce who it was. A divorce case can only be concluded three ways. The case can be withdrawn, the parties can reach an agreement and report their settlement to the court and the parties can try their case and have the court decide the outcome. In this case, we were hired to replace the attorney originally hired to handle the divorce with the expectation that the case was going to be tried and decided by the judge. I stepped in and participated in a Special Masters’ Pretrial days after being engaged, so as not to delay the matter from promptly reaching trial. I do not accept that my level of preparation was substandard. I recommended during the intake interview that a deposition be conducted to obtain testimony and commit the adverse party to a single story so there would be no surprises at trial and to demonstrate that litigation is an unfriendly and uncomfortable process. However, the client reversed the authorization for the deposition. This, in my opinion, stifled the best strategy available to promote settlement as an alternative to trial. During the 3 months we represented this individual, we frequently received more than 5 contacts per day by telephone or email, sometimes substantially more. We clearly communicated that all contacts are billable events and, as such, consume retainers. We urged the client, in our engagement agreement and subsequent communications to be careful about the expense of too frequent contacts for issues of minor or no importance. These warnings were not heeded. Still, emails received must be read and messages left must be listened to. We have a clause in our client/attorney engagement agreement that provides that we may charge at 1.5 times our hourly rate for services provided outside business hours and on weekends. This individual’s communications seemed to intensify at those times, especially on weekends. We advised that if the intrusion on our private time for non-emergency communication continued, we would charge at the increased rate, but the contacts did not stop. Regarding returning communications, there are several points. First, we try to respond no later than within 24 hours. Contacts are triaged and important contacts are returned first. On any given day, there might be a trial being presented for another client whose matter had been in preparation for months. These are intensely important to us and sometimes we are slower responding. Other reasons for less than immediate responses are weekends away with family and when I am ill. I know most clients accept that. This former client also says that I am available for lengthy discussions, but not about the client’s case. I never reveal information about other or former clients, but I do use examples from other cases, both ones I have researched and ones I have been involved in, that illustrate ideas I am explaining. I think the examples are useful to the client in reaching an understanding of the law and possible outcomes. These discussions are, therefore, always in the context of the client’s matter. In the particular case complained of, settlement could not be reached because the opposing party did not change position during my representation, despite an improved offer from our side. There was nothing more to be done other than to prepare for trial and wait for the assigned date. As trial approached, the client was expressing anger and personally attacking my assistant and me and finally engaged another attorney who filed an appearance in lieu of mine. Throughout the difficult representation we strove to be patient and respectful.

I hired attorney James Wing Jr. for my son's case , ( a criminal case) and my family and I are so happy with the out come of the case. He was facing some major felony charges. Jim always kept us informed and was ready with plan "B or C " just in case. Honesty and trustworthy and knowledgeable are de...finitely in this mans description. His performance in court is brilliant! He was able to reduce the charges and sentence more than the other lawyers who were working for the other parties that were involved in the same criminal case as my sons. James Wing jr. is definitely the man for the job !
