John Doe v. The Hartford Insurance Company

Michael S Altman

Case Conclusion Date:December 31, 2007

Practice Area:Personal Injury

Outcome:Successful Insurance Fair Conduct Complaint

Description:Shortly after the Insurance Fair Conduct Act was passed into law in Washington State, I filed one of the first complaints under this act and successfully settled my clients Underinsured Motorist Claim. After successfully obtaining the policy limits from the 3rd party responsible for the accident that injured my client, I made a demand to my client's insurance company for additional settlement funds under his Underinsured Motorist coverage. His Insurance Company responded with a "nuisance offer" of $500.00. Upon receiving this "nuisance offer" I promptly filed one of the first Insurance Fair Conduct Act complaints in the State of Washington. Shortly after receiving my complaint, his insurance company promptly resolved the case by making a much more substantial settlement offer that we accepted.
