Description: This case involved a wrong way driver on I-215 resulting in the death of Michael Ponzio. The defendant repeatedly engaged in dilatory tactics, refusing to engage in discovery based on the Fifth Amendment privilege, and unsuccessfully petitioned the Nevada Supreme Court for multiple emergency stays and writs of mandamus. After a series of delays, the court found that defendant failed to participate in discovery frustrating plaintiffs ability to examine defendant’s purported defense that she suffered a black out or lost consciousness. These procedural gaffes ultimately won plaintiffs summary judgment as to liability and the court granting plaintiffs’ motion to compel defendant to produce financial discovery relating to the punitive damages claim.
