Practice Area: Criminal Defense
Outcome: Not Guilty
Description: Forty seven year old government employee was indicted for Possession of Heroin and Trafficking in Heroin after a police task force consisting of two local police departments and one federal agency sifted through her trash and executed a warrant for the search of her residence. It was alleged that ten (10) packets of heroin were located in the trash. This case received media attention as it revealed questionable tactics by law enforcement officers after testimony provided that detectives posing as garbage men, randomly seized trash from homes to look for evidence of wrongdoing. After the State rested, the trial court granted the defense motion for acquittal. The defendant was found not guilty on all counts and released.
