Outcome: Not Guilty

Description: Client, driving a sports car, was stopped for speeding late at night, which he emphatically denied. He was angry at being stopped, but agreed to take the Standardized Field Sobriety Tests. Police placed him under arrest, and then charged that he refused to submit to a breath test. After the arrest, in their words, the police gave him another opportunity to attempt the tests. At trial we suppressed the arrest, and he was found Not Guilty. We also won at the license suspension hearing where the allegation of a test refusal could have resulted in a 120 day suspension.
