Is it illegal for a minor to possess or smoke cigars in public, private, or neither?
I know minors can't buy tobacco until he or she is at least 18 years old, but what about possessing them, and using them? Also, are the laws with these the same as drugs, where you have to be caught in the act?
Pursuant to Fla. Statute 569.11- It is unlawful for any person under 18 years of age to knowingly possess any tobacco product. Any person under 18 years of age who violates the provisions of this subsection commits a noncriminal violation as provided in s. 775.08(3), punishable by:
(a) For a first violation, 16 hours of community service or, instead of community service, a $25 fine. In addition, the person must attend a school-approved anti-tobacco program, if locally available;

Yes, they have to be caught in possession (or on camera in possession).
Another's "word", standing alone, with no physical or other corroborating evidence, would almost certainly not be actionable.
