Can I drop off the RV (in her name) that was court ordered for me to refinance, with her. Unemployed at time of divorce due to d
I had been unemployed 6 months at time of divorce due seizures and still unemployed 7 months, since divorce granted, due to dx seizures
It sounds like you have a reasonable defense if you are accused of being in contempt for not doing what you were ordered to do, but if you were awarded the RV subject to you refinancing it, it may be noted that no one can be certain if they will qualify for refinancing. You should attempt to do so, if you are not able to refinance it, find out what it is worth and ask your ex if she would want it or if you should sell it. If you owe more than it is worth, you'll have to figure something out, because you'd need to pay it off in order to give the buyer a clear title. It may be a good idea to go back to the lawyer who represented you or to hire a lawyer to ask about options which could include bankruptcy but there are potential complications if you were to take that option.
No one should ever take action based on a response to an AVVO question since meaningful legal advice has to take into consideration factors that have NOT been disclosed or discussed.
If she agrees to that. Otherwise, it depends on what the decree says. If there’s court proceedings over it, the court will likely order the the sale of the RV. If there’s money leftover after the loan and costs are paid, the proceeds will be distributed. The distribution depends on a number of factors.
