"No good deed goes unpunished." When I heard this client's story, I was disturbed by the employer's alleged actions. Cost was an issue for this former client, so I waived the small retainer to help because I found case seemed to have merit. But as many of us know, "beneficial actions often go unappreciated or are met with outright hostility." Notably, the former client complains about waiting on a checks ("plural")--which means I worked out an economic resolution to her claim. In other words, at the conclusion of this matter, the issues were favorably resolved. The former client was told that the checks would take 2-3 weeks to arrive, if no issues. This was based upon information provided by the former employer. I explained that the former employer was responsible for drafting and mailing the checks. Before 2 weeks expired client had called quite a few times asking about the checks. Client also asked if my office could write her checks. My office does not engage in writing employee checks. After being advised about a delay in the checks, the client was told there would be a delay in receiving her checks. Instead of 2-3 weeks, the checks arrived at approximately 4 weeks. The former client claims they did all the work, but never spoke to a decision-maker. Client does not mention that they were never offered any resolution until my office engaged the employer. The former client felt a mastery of employment law based upon Google searches and advice from friends--who do not practice law. On several instances she brought up multi-party, class action cases stating how much money they person received. I kept explaining that those dollar amounts were based on multiple plaintiffs. The former client often confused the case for an injury case or common ideas of car accident or injury cases. On several occasions, I explained how the damage models were different. And we couldn't just ask for money without any basis. I think the client was a bit money hungry. I enjoyed the case, at one point I thought about disengaging the case because the client was not good at listening, but I felt compelled to help her because of her lack of understanding. Ultimately, this former client left my office with two checks. I feel that justice was achieved because the former client was not being taken seriously by her employer until I got involved. If you a hire an employment lawyer, hire one who will explain the law to you and will tell you that you are wrong. You do not need a "yes man" or a "do boy", you need an advocate.
