Craig contacted us after we had filed and been accepted for a Chapter 13 bankruptcy to let us know that he had discovered that one of the companies that we listed in the Bankruptcy had not met a filing requirement and that he was willing to pursue making a claim/filing a lawsuit on our behalf. He wa...s very clear on the steps that needed to be taken and the information that he would need from us. He always asked if we had any questions during every call before ending the call. He was very prompt in answering our phone calls to him. He was very personable and took whatever time was necessary to be sure we understood exactly what was taking place. In the end he was able to secure a $2000 settlement for us. We will use that settlement to establish an emergency fund so we can continue to make our payments in a timely manner and have the security of a separate fund should we run into an unexpected expenses (car repairs, medical bills, etc.) He was awesome all the way through the process and we are most grateful he took the time to review our case and find the untimely response which benefited us with the added security of an emergency fund going forward. The Court denied CitiMortgage's motion to dismiss, finding the Plaintiff had stated claims under 11 U.S.C 524, 11 U.S.C 362, and Bankruptcy Rule 3002.1

Bivens v. NewRez LLC and CitiMortgage, Inc. (In re Bivens), 2021 WL 863343 (Bankr.M.D.N.C., Mar. 2, 2021)

Court denied CitiMortgage's motion, holding that the Bankruptcy Court had jurisdiction over the Plaintiff's claims under Bankruptcy Code and Bankruptcy Rules

Carnegie v. Nationstar Mortgage LLC (In re Carnegie), 621 B.R. 392, 2020 WL 5887541 (Bankr.M.D.N.C. 2020)

The Court denied in part and granted in part the defendant's motion to dismiss.

Williams, et al. v. Citifinancial, et al. (In re Williams), 612 B.R. 682, 2020 WL 411291 (Bankr.M.D.N.C. 2020)

The Court denied the defendants' two motions to dismiss, findind that the plaintiffs had plead plausible causes of action as to the automatic stay and discharge injunction. The Court dismissed the FDCPA claims solely on jurisdictional grounds.

Hilton v. Stern & Eisenberg, P.C., 2018 U.S. Dist. LEXIS 113574 (M.D.N.C. 2018)

The Court granted Plaintiff leave to conduct jurisdictional discovery and denied Defendant's motion without prejudice.

Clark v. Absolute Collection Serv., 741 F.3d 487 (4th Cir. 2014)

The Fourth Circuit vacated the District Court’s judgment and remanded for further proceedings.

Lox v. CDA, Ltd., 689 F.3d 818 (7th Cir. 2012)

The Seventh Circuit reversed the District Court's opinion as to the appealed count. The 7th Circuit found that the statement regarding attorney fees was materially false on its face and, therefore, required no extrinsic evidence.
