I am of course never happy when a client is dissatisfied, but I appreciate hearing complaints for two reasons: 1) It gives me the opportunity to address issues going forward that, at times, I did not know were problems, and 2) It gives me the opportunity to explain details of the practice of law, at least my practice, that lawyers sometime believe their clients know, but sometimes don’t. First, however, I must address significant inaccuracies in your account. - You were a client of this office for 9 months, ending at the end of July, 2017 – not 2 years; You explicitly informed me, in July of 2017, in writing, that you were not going to pursue the matter any further, with new counsel or otherwise; The amount you paid was significantly less than indicated. I refunded several hundred dollars at the conclusion of our agreement (8/2017). You cashed the refund check; My billing does and did include the date, the task billed for, and amount of time for the task. I have used the same form for about 25 years, without complaint. I must surmise that you never actually saw the multiple statements we sent because you were having difficulty getting regular mail (or phone) at the time; Initial letter: I emailed you several times (3/21 and 3/31) explaining who responded to the our initial letter and how, and you acknowledged receipt of these emails, so you were aware that it was sent; Lessons: This was mostly a communication problem, not a question of laws or remedies or even legal skill: We may well have achieved a satisfactory outcome in this matter; in fact I think it likely. Although communication must at some level be the responsibility of both parties, lawyers must take the primary initiative in ensuring the client is regularly informed of the matters, especially when as here, the matter is not in litigation and is otherwise not immediately urgent. I have now instituted a system of calendared reminders (tickles) specifically in non-urgent matters. Conversely, Clients of any professionals should contact the professional if you have not heard from them in a reasonable amount of time. You have a right to be informed of what is happening in your matter, even if it is nothing. I fully understand the complainant’s frustration, even if his memory of the details has waned in the 18 months since these matters transpired, and I certainly do not blame him for that frustration.
