Poor quality

I hired Brian for a civil RALJ appeal. It seems the lawyers who do these types of appeals are limited...he was one of a few who responded to my inquiry. He didn't seem easy to talk to or very forthcoming with information at the beginning which I felt uneasy about, but it seemed my options were limi...ted, initially his fee seemed reasonable, and he seemed sure he could be successful. He got the appeal filed with the court with issues designated for review, but when he wrote the appellant brief, and gave me the draft for review, it was truly terrible, like a high school student wrote it. I had three issues designated for review and he only addressed two of them. There were typos and misspellings throughout. He had facts and dates of events wrong. He signed it "Attorney for Mr. XYZ with XYZ being someone else's name, not mine. Also, the main reason I hired him is because I understood that I needed case law cited and I didn't have the know-how for that. But, he only cited one case law example, and it was regarding something that wasn't even my concern to begin with. In fact, he had asked me only two days prior "what was your concern about that again?" but still he didn't address those things. I marked up his draft with all the errors and issues and questions. I proposed that I write a draft instead, keeping his basic format, so that at least all the facts would be correct and my actual concerns stated...then he could give feedback or edits. When I gave him my draft, he scoffed at it and said there was no way I could win with that and wanted to use his brief instead. I thought it ridiculous if he thought his could win with all the errors and omissions, and I was put off by his rudeness and lack of explanation so I terminated him. This was only three days before the brief was due. I filed my brief. I asked for a refund for work not done, proposing a 40 percent refund which I thought was more than fair. He had charged me 4000. I have not received any refund. He seemed nice enough at first, but turned out to be rather rude. When asking questions, his answers were one or two sentences at the most without any meaningful explanation as to why or how. Additionally, when I filed my own brief, I then found out that a hearing date had already been scheduled...he didn't inform me of that.

This is pretty depressing/upsetting. Due to the duty of confidentiality, I cannot address the allegations of this complaint. However, it does not come close to a fair and accurate portrayal of events. The public record of this case reflects that the client lost a protection order hearing in district court, while being represented by a different lawyer. This client filed an over 60-page declaration that was alarming and damning. I do not know if the other lawyer attempted to block that declaration from being filed, but it should not have been filed. The appeal process was handled appropriately, and ultimately this client (on their own) filed a lengthy appeal brief that suffered from the same problems as the response filed in district court. It also included three legal issues, of which one is not an actual legal issue. Case law on these types of cases is limited. In all cases, we strive to have a respectful, flowing conversation with our clients, to both keep them informed, aware of deadlines, and to get input on the case. In the case of fee disputes, which are quite rare, we try to be as accommodating as possible. We are always available to meet with former clients to address any concerns they might have.
