KNOWLEDGE FROM THE FIELD. EXPERIENCE IN THE COURTROOM. FOCUSED ON YOUR SUCCESS THROUGHOUT.

Any experienced construction lawyer knows construction law. The difference I bring is a thorough understanding of construction. I spent ten years in construction before becoming a construction lawyer. I know the issues and opportunities that will matter most in your case and will give you the edge in identifying and developing your biggest advantages.

My approach is crafted specifically for builders and owners to deliver the personal attention, expertise, and efficiency that's been long overdue from construction counsel. The success is all yours. I'm here to deliver it.

Clients deserve effective, efficient solutions that make the most sense for their businesses. That's why I drive toward uncomplicating your claim or dispute, finding a simple narrative to persuasively tell your story and provide you the most effective representation possible. And I come to you so I can learn about your project and your business, meet your people, and review your documents where you keep them. It's expert construction counsel delivered to your door.

I have successfully represented contractors and owners in complex construction disputes ranging from highways, bridges, and other public infrastructure projects to a wide variety of private developments and residential work. I work on disputes throughout the Puget Sound area and across the state in places like Wenatchee, the Tri-Cities, Spokane, and Pullman. I also help homeowners that understandably feel overwhelmed by the complexities of construction and construction law. In addition to contracting issues and dispute resolution, I represent contractors with federal, state, and municipal bid protests, federal contracting issues, and bond, lien, and retainage claims against federal, state, and private projects.

I'm obsessed with your success and the service you receive. And I'm driven to always improve the quality and efficiency of the expertise you hire me to provide. Communication, flexibility, and technology are at the core of this, including leveraging the latest technology available to gather and manage evidence and provide you round-the-clock access to your case from anywhere. You always know where you stand.

Professional, Responsive, Effective
Berger Construction Law helped us settle a dispute with the contractor we’d hired to remodel our house. We were referred to Tymon through a recommendation from another attorney. When I explained our problem in the initial call, Tymon confirmed that handling our situation was ‘right in his wheelhouse,’ and he was absolutely correct. Throughout the process, Tymon listened attentively, provided candid feedback and was always responsive. His familiarity with both sides of the construction equation give him insights that proved invaluable for us. In the end, Tymon quickly and efficiently negotiated a settlement that we could live with at a price that was more than fair. We give Tymon our highest recommendation.

Succeeded when another attorney failed
I first hired a different attorney at a large firm to help with an issue I had with a general contractor who was threatening me. She told me that I was hosed; Because of the contract I had signed, this bully of a GC had me over a barrel. Before I forked over ~$30k to the bully GC, I contacted Tymon Berger. Thank heavens I did. Tymon took the time to investigate the contract, the GC, and the situation. He listened to what I had to say -- something that not every attorney does. He understood my wishes and followed them clearly. And he came up with a clear and fair strategy to help me. I never had to pay another dime to the GC. We settled amicably. Tymon is a great communicator. He managed my expectations well and always followed through on commitments. Working with him was such a positive experience. I pale to think that I almost forked over $30k (for work not completed) just because that previous lawyer didn't care to listen or bother. So yeah, Tymon is my hero.

Extremely Knowledgeable & Helpful
Stuck in a difficult situation with a contractor who sprung a large last-minute bill on us, Tymon's expertise and guidance was invaluable. He reviewed our builder's contract (free of charge even!) and gave us outstanding advice that led to a fair compromise -- saving us a lot of money. He's clearly very knowledgeable, and has prior contractor experience so he understands both the practical and legal aspects of the industry. And he was able to explain our legal options in a way that was easy to grasp. I'd highly recommend Tymon.

Contractor's Lawyer
We hired Tymon to help us with a dispute with a GC. Tymon knows the business, knows the language, and the used the perfect mix of construction perspective and legal leverage to get the claim (very) favorably resolved for us. Couldn't be happier with his representation. I really appreciate the well-rounded approach Tymon brings to the table. He's ideally suited for representing contractors in anything related to construction.

Our family highly recommends Tymon!
Tymon helped our family through a very difficult situation involving a contractor that left our home (roof and attic) in disarray. Tymon took his own time in the beginning to review the facts with us and to come up with a proposed strategy that could help us recover some of the losses we had incurred. He laid out the strategy, we came up with a budget we could handle, and we decided a few months later to proceed with legal action against the contractor. Tymon was always honest and worked hard behind the scenes to make things happen. I honestly thought that it was probably not possible that we would ever see any compensation out of this and we would be stuck with all repair costs, but in the end, he won our case and we received a payout from the contractor's insurance company, which in the beginning we thought would be unlikely. He was a lifesaver for us. What I was most impressed with is that even though it was clear that he and his firm handled large accounts that probably garner them so much more, he treated our tiny little situation like a big one and gave it just as much effort and care. We are still very grateful for Tymon's help and creativity in handling our particular case, and really benefited from his legal expertise. Highly recommend!!!

Helpful, Knowledgable and Sincere
Mr. Berger is a fairly new lawyer but he is passionate and persistent in getting all the facts and answers. He is a quick thinker and I was impressed by the way he could gather all the facts very quickly and summarize them and come up with a strategic plan to best fit my needs and goals. He is aggressive in getting results but at the same time I felt he was compassionate and really cared about helping me get my situation resolved. I also liked the fact that he followup up after it was over to find out how everything turned out and to see if I needed additional help.
