Medical Abuse Allegation

Medical Abuse – What’s that?? That was my first reaction when being contacted by a Social Worker in Everett, WA. after being inappropriately referred to CPS by a prominent Children’s Hospital in Seattle, WA. Imagine living day to day with a child who has a complex chronic illness and is unable to e...at more than 8 different foods without intense suffering and pain. Imagine that child being unable to live life as a child should be able to, and having to give up loved activities such as dance, gymnastics, swimming and others from a pure lack of energy and unrelenting abdominal discomfort. Imagine this illness being undiagnosed! As a parent, as a good parent, you would go to the ends of the earth to find a diagnosis, and thus potential treatment plan for your child. You would explore every avenue possible to help your child. You would have tests performed; medications tried, and even look into any and all alternative medicines available. This is what a good parent would do. This is also what the local Children’s Hospital considers Medical Abuse. Too many doctor visits, too many tests, too much trying! When this allegation was first brought to my attention, I thought there was no way anyone who knew us and had been part of this ongoing life with us would even for one second do anything other than laugh at this absurdity. I quickly found out, however, that CPS is not interested in digging deep into those who truly know. The system appears to be designed for a hospital to send in a referral, and CPS to do a less than adequate job investigating. As I saw more of what I perceived to be ineptness occurring in the social worker assigned to our case, I knew I had to do something to protect my child and I from the absurdity of the allegation….an allegation sent in 5 months after my child had even been seen by anyone at this hospital! Upon researching online, I quickly came across Dana Brown’s name, and was quickly drawn to the information regarding defense against CPS found on her website. I emailed Dana on a Sunday, and received a response back that very day. After a discussion with Dana, I hired her to represent me. From the start, Dana was engaged and active in my case. She listened earnestly and openly to my situation, reviewed my child’s medical history, and believed in my innocence. She provided me with needed education on the process CPS would be following, expectations I should anticipate, and hope that this case could close as ‘unfounded’. Dana communicated directly with the CPS social worker, ensuring that CPS was following statute and law. She provided information they seemed to be neglecting, and repeatedly reminded them there was no evidence to support this allegation. Her tenacity, knowledge, drive, determination and never waiving commitment to me ultimately ended in an ‘unfounded’ ‘verdict’ from CPS! Alongside Dana’s amazing legal skillset, is also a highly developed emotional intelligence proficiency. When thrown into situation like this, stress, worry, concern, and even anxiety seem to become prominent daily. It’s imperative to have legal representation that understands this component as well as the technicality of the law. Dana was always compassionate, understanding, available, and supportive throughout our work together. She was also able to convey a sense of partnership with me on my case, and encouraged and respected my thought process. I would highly recommend Dana for any case involving CPS, in particular the nebulous and unreasonable allegation of Medical Abuse. She will fight for you, for your family, for your rights. And, she will walk through your case with you…not in front of you, not behind you, but right alongside you.

Juvenile Court Case

About a year and a half ago, our life turned upside down. We were overwhelmed not only psychologically but also legally. That is when we started working with Dana Brown. To summarize the entire experience in one word, it was spectacular. From the outset Dana was friendly, amiable, and at times even... providing psychological support. She was both our anchor as well as our guide through the emotional and legal maze. Her vast knowledge and experience as a juvenile attorney were invaluable for the ultimately positive outcome of the affair. But equally invaluable was her ability to communicate and share her insights with us. We cannot count the number of times when the events of the day would seem to point to a dark and hopeless outcome, only to be reversed by Dana's thorough and patient explanations. Dana is a micro-manager and a controller in every positive sense of those words. We learned very quickly that the complexities of the judicial system require extreme control over a wide range of factors. Sure, there were times when her drive to micro-manage contradicted our personal preferences; but at the end, we believe she was right. Her determination, however, was not single-minded. She was always open and receptive to any ideas we had. Knowledge, experience, and sensibility aside, Dana is also well-connected to the network of attorneys, judges, probation officers - the decision makers. It is important to point out that her role in that network is not self-imposed and obtrusive; on the contrary, she has a reputation for being very much liked by the legal community. As a result of all of these virtues, Dana was able to craft a plea agreement which was most favorable for us. There is little doubt in our mind that the outcome (and the experience itself) would not have been so positive if our case had been handled by someone else. We recommend Dana whole-heartedly. She was (and is) spectacular.

Falsely accused of child abuse

I hired Dana as my lawyer after a prominent hospital in my area falsely accused me of child abuse. Subsequently CPS filed a petition for a dependency involving my children. Dana quickly started work on my case. Dana's high level of attention to detail and professionalism saved my children from ever... being involved in a dependency. My case was complex and often times overwhelming with the amount of medical records involved but I always felt Dana was right there fighting with me the whole way. She has great resources and knowledge of the legal system. Her presence is not missed in the court room. She will get you the result you deserve. Dana always kept me informed as soon as new information became available and always worked with me on making decisions regarding my case. With her guidance I was able to overturn the "founded" ruling from CPS and clear my name. I couldn't have done it without Dana and am extremely grateful for her expertise.

UW Discipline and King County Drug Diversion Court

Having come highly recommended to me, I can certainly say Dana Brown is an excellent attorney. I was being charged with possession with intent to sell and was facing, an almost assured, jail time for several years and three felonies on my record. Within the first meeting with Dana much of my anxiet...y was relieved. It becomes immediately clear that not only does she want to help people any way she can, but also that she is more than capable of doing so. She had previous experiences with the UW Discipline system and was able to use her knowledge of the system to significantly reduce the initially proposed sanctions. Dana was even able to get two of the directors/administrators of King County Drug Diversion Court to come and speak on my behalf, as well as a letter written by the lead prosecutor, at my hearing with the disciplinary board. Furthermore, she was able to help me get into the King County Drug Diversion Court. Under her guidance I quickly went from having no knowledge that such a program even existed, to understanding the ins and outs of seemingly every aspect of the system, as well as a full understanding of my responsibilities and the ensuing repercussions of disobeying the rules of KCDDC. It was always reassuring, and even a bit humorous, to witness Dana enter the court room and know all of the staff on a first name basis. As if it were not enough to hear her intimate knowledge of the Drug Court and explain everything I needed to know regarding my involvement with it, my confidence was only further bolstered upon seeing and hearing her describe the program again in the informational video that is shown during the trial phase of Drug Court. Dana was able to guide me through the whole experience while routinely checking in on me to make sure that all was well and remind me of upcoming court dates and hearings. In sum, Dana Brown is a fantastic attorney whose understanding of, and previous experience with both KCDDC and the UW Discipline system becomes abundantly clear within your first interaction with her. She makes sure to let you know exactly what all of your options are and what the potential outcomes of those options are. She makes sure to keep you informed regarding what is going on and is very quick to let you know when something changes. Having never doubted her level of care for her clients while working with her, it is made even more clear now that she will still occasionally check in on me (after the case has ended) just to make sure that I am doing well. There is not a doubt in my mind that hiring Dana Brown was the right choice. Upon finishing working with her, all charges against me have been dropped, I have been reinstated to the University of Washington, I have a deep understanding of both KCDDC and the UW Discipline system, my life has taken an entirely different and more positive direction, and, if I or anyone I know is ever in need of legal help or advice, I know exactly who I will call or recommend.
