Sean Olender prepared my “same or substantially similar” I-140 letter for my adjustment of status application. My salary increased a lot since the labor certification was filed and Sean said that the USCIS standard operating procedures and memos said that the officer could take substantial changes i...n salary as an indication that the jobs were not substantially similar. Sean added tables to his letter with the difference between the prevailing wage in the county I used to work in and the one I work in now showing a big difference geographically and then he also included a table with old OES wages from the time the labor certification was filed to show the change in wages due to inflation. The changes he showed were due to exogenous factors totaled an 86% wage increase which put my additional increase only 15% or 20% more than that and made it look not so big.
