Unmployment Case

The environment at my last job was very intolerable. For instance, the owner would yell and curse at employees almost everyday (calling them anything from a f*cken idiot to a f*cken a**) and he would do this in front of other employees . I resigned from my last job after working there for only six... months due to the intolerable work environment. I then applied for EDD unemployment benefits however I was subsequently denied. I filed an appeal and hired Sean to help me. Besides a free consultation, Sean contacted three of my former coworkers as witnesses and he drafted three declarations to help in my appeal (my former coworkers were unable to attend the hearing therefore Sean drafted the declarations as witness statements). He also attended the hearing with me. A couple weeks after the hearing, I found out that I had won the case. I was charged a fixed fee for his services. Sean is an excellent attorney and I would highly recommend him to anyone.

quality service

I-485 Adjustment of status RFE

Sean Olender prepared my “same or substantially similar” I-140 letter for my adjustment of status application. My salary increased a lot since the labor certification was filed and Sean said that the USCIS standard operating procedures and memos said that the officer could take substantial changes i...n salary as an indication that the jobs were not substantially similar. Sean added tables to his letter with the difference between the prevailing wage in the county I used to work in and the one I work in now showing a big difference geographically and then he also included a table with old OES wages from the time the labor certification was filed to show the change in wages due to inflation. The changes he showed were due to exogenous factors totaled an 86% wage increase which put my additional increase only 15% or 20% more than that and made it look not so big. Even though I was not a supervisor before and I’m a supervisor now, Sean went very carefully through the OES codes and pointed out that Department of Labor did not create a separate OES code for managers in this field because it believed that supervisor/managers in this job had job duties very similar to non-supervisory personnel. Sean devoted a lot of time to the letter and it was meticulous and very well organized drawing from the Department of Labor’s OES and O*NET publications and also USCIS memos and standard operating procedures on the standard for same or substantially similar.

EB1c filing

Sean filed my EB 1(c) multinational manager petition while representing my employer, one of the worlds top IT and management consulting firms. He worked carefully to precisely describe my job and educational background and the jobs and educational backgrounds of my direct reports. He prepared a nine ...page letter to accompany the petition carefully explaining why the evidence submitted satisfied every legal requirement for this classification. He worked tirelessly with me and the companys HR department to prepare the evidence necessary to submit a flawless case. He works not just to get EB-1(c) cases approved, but to get them approved without the delay of a request for evidence. My case was approved quickly without an RFE.
