Beware of incompetence, contradictions and lack of preparedness

March 14, 2023 This review is specific to Amy Harrington in her capacity as a referee for a Partition case. At the introductory Zoom call to discuss the details of the case, Ms. Harrington acknowledged at the outset that she did not read the Interlocutory Judgment for the Partition, which was w...hat we here to discuss. She carried on in an aggressive tone and acknowledged when others spoke by tossing her head to the right and to the left, as much to say what the other was saying is annoying or irrelevant. It was very insulting. She was not prepared and she was condescending. This case is very detailed and has unusual aspects, which is why it was imperative that she come prepared. She did not. March 21, 2023 The Realtor we recommended confirmed that she had not been contacted by Ms. Harrington. As of this date, we had yet to receive communication that she had started the process. April 4, 2023 We received an email from Ms. Harrington informing us that she will be walking the property on April 5, 2023 at 11:00 am. Property walk was subsequently delayed to April 12, 2023 and she would provide an update after the walk. April 17. 2023 No updated from Ms. Harrington. We emailed asking for an update. May 4, 2023 Ms. Harrington provided a doc from the opposing party regarding the septic. We explained the pump house was permitted but not the septic. She argued that it’s a he said/she said even though the permit history dating back to 1978 show no septic system permit. No, it’s not a he said/she said, it’s in black and white on the County of Sonoma permit website for all to see. There is no permit for the septic or the main electrical panel to the property. In one email she explains that we’ll have to disclose the unpermitted items, then in a phone call on May 5, 2023, she says that she, as the referee, is not obligated to disclose defects. So, which is it? May 6, 2023 We expressed our concerns that if this item is not enforced, then what about the other items in the judgment? Her response was something like, they (the opposing party) didn’t object to the other items, just the unpermitted items. WHAT? WE HAVE A JUDGMENT. The negotiations are over, why is she allowing them to object? Referee (Ms. Harrington) continues to confuse the pump house electrical panel (permitted) with the main electrical panel to the property (unpermitted). She didn’t know the difference, which is disturbing. There were numerous emails and calls regarding the items in the Judgment and whether or not she would follow the judgment. The negotiations were over. The terms of the judgment needed to be followed. During this process and noting her incompetence and contradictions, we interviewed several other referees. Every single one of them were appalled by her behavior. I strongly advise and recommend that you avoid and never hire this individual as a referee.
