Henry Murphy Burgoyne III

Hank Burgoyne is an AV-rated business and intellectual property lawyer with a decade and a half of experience resolving contract, trade secret, Internet, corporate, advertising and related disputes.

As a trained mediator, business owner and one-time federal court clerk, Hank sees his clients’ disputes from a variety of angles. He recognizes that to a client, a dispute looks more like a business problem than a legal case. He therefore takes the time to understand each client’s business, and unique business priorities.  Hank knows that legal disputes can sidetrack even the most forward-looking of companies. Hank has an advantage over other business and intellectual property litigators, in that he has negotiated and drafted contracts ranging from software licenses and SaaS terms to executive-level employment and LLC operating agreements. He has successfully represented plaintiffs and defendants in some of California's most important Internet-related advertising cases, both in the trial courts and before the Ninth Circuit U.S. Court of Appeals. As a former newsroom lawyer, Hank also counsels businesses on trademark, tortious interference and defamation issues, and has secured favorable results in dozens of unfair competition lawsuits. He has particular expertise in trade secret and employee mobility disputes, and in the use of digital forensics and electronic evidence.

Hank graduated with distinction from Stanford Law School, where he was a teaching assistant to former Dean Kathleen M. Sullivan. He then clerked for U.S. District Court Judge William Alsup in San Francisco. After his clerkship, Hank litigated business, intellectual property and technology cases for Keker & Van Nest, an American Lawyer "Litigation Boutique of the Year." Hank also negotiated intellectual property and other commercial agreements for the Silicon Valley office of Greenberg Traurig, and founded Kronenberger Burgoyne, a San Francisco business and Internet litigation boutique.
