E-mail Communication

Mr. Richter answered a question that I posted. I sent Mr. Richter an e-mail related to that question for further clarification because his answer put into question what other attorneys had told me. He responded and said that the notice of appeal is the same regardless of my motion for reconsiderati...on because I would want to file an appeal for the initial order and not an appeal of the denial of my motion for reconsideration. I responded and cited California Rules that a denial of a motion for reconsideration is not separately appealable, but it is reviewable as part of my appeal of the initial order ... further proving that the motion for reconsideration ruling did changed the deadline for my appeal.

This is really the problem with AVVO. You try to lead people like this person down a safe path so that they do not lose based on other issues that may arise. If you cannot understand that, then continue your apparent practice of waiting for the last minute and then hoping you read the California Rules correctly. By the way, have you checked with the clerk to see how this particulare Court wants things done? Have you ever heard of filing the Notice of Appeal to toll the time, and then merely dismissing it if you are successful with your Motion for Reconsideration? Probably not, but apparently you know so much more than all of us on here. Please go ahead and follow your own advice. I have successfully either gutted the opposition's case or had it dismissed outright when they did what you are proposing. Do not contact me again in anyway, including posting your misguided and defamatory statements on this site or any other site.

not happy at all.

I felt this Attorney was not at all competent. He accepted mine then never returned phones calls. Was extremely slow in completing work and was less than honest in detailing his hours

It is indeed unfortunate that the case did not turn out the way you wanted it to. However, failing to follow the instructions from your attorney usually results in unnecessary complications which will increase the amount of attorney fees. Regarding your complaint on phone calls, I have reviewed my call log, and all phone calls were returned within 24 hours. I apologize if that is not fast enough for you, but you should know that attorneys are not always in the office. We do have to go to Court and other events in which we cannot use our phones. I wish you well.
