Mandy D. Hexom

Originally from San Diego, Ms. Hexom graduated from the University of California, Santa Barbara in 1997 with a double major while interning at the Santa Barbara District Attorneys Office, working closely with criminal investigators and felony district attorneys. In 1996, she also obtained a Certificate in Mediation. During law school, Ms. Hexom worked for the Oregon Department of Justice on the state tobacco litigation and represented the State of Oregon in numerous trials while clerking for the local district attorney's office. While pursuing her law degree, Ms. Hexom attended Willamette University's top-ranked Center for Dispute Resolution and served as Editor-in-chief of Willamette Law Online. After law school and moving back to her hometown of San Diego, Ms. Hexom represented physicians and hospitals in medical malpractice litigation throughout Southern California and then joined a business litigation firm in 2002 where she developed her business litigation practice.

Some representative clients and cases include:

• Most recently, served as trial counsel for a commercial retail center, obtaining an award of over $3 million dollars for the clients under their cross-claim and prevailing on the complaint filed against the clients for fraud, breach of contract, rescission and unfair business practices.
• Trial counsel for an East Coast-based marine performance business related to a dispute concerning contractual obligations in the offshore powerboat racing industry.
• Trial counsel for a residential homeowner and a framing contractor in arbitration proceedings before the California Contractor's State License Board.
• Trial counsel for a San Diego County ranch in an easement road maintenance case.
• Counsel to multiple contractors and design professionals in state litigation proceedings involved in breach of contract litigation and personal injury actions involving gas station and commercial retail projects.
• Counsel to retail commercial centers in all facets of litigation, including breach of contract, fraud, declaratory relief, specific performance and rescission claims, unlawful detainer actions, collection claims and bankruptcy actions.
• Represented an international semi-conductor company, successfully resolving breach of contract claims.
• Secured a large bankruptcy claim for a shopping center creditor against a former tenant in a Chapter 7 proceeding.
• Counsel to an energy partnership involved in a derivative action concerning multi-million dollar energy development projects, which was successfully settled in favor of the client.
• Counsel to car dealerships involved in various litigation matters including claims made under Consumer Legal Remedies Act, Unfair Business Practices Act and the Song Beverly Consumer Warranty Act.
• Counsel to individual employee in a wage and hour case, securing a settlement for the client against a national student loan corporation.
• Counsel to individual and business property owners as well as home owners associations in multiple lawsuits concerning easement rights, successfully resolving easement claims in the clients' favor.
• Consult with employers on employment law issues in various industries such as manufacturing, corporate and the restaurant industries.
