I began my law career as a trial lawyer for Federal Defenders of San Diego. I am a 3rd generation lawyer beginning with my grandfather R.G. Smith who began his practice in 1916 during the prohibition era and my father, Raph Smith, and 1950 Northwestern Law graduate and former judge in Phoenix, Arizona. I graduated 1987 Arizona State University with a BS in Economics followed by a law degree 1990 California Western School of Law where I received the American Jurisprudence Award in trial practice. My first job was with former Federal Defenders and later hired as a trial lawyer. My father taught me many trial skills and he actually tried a case with a young Chief Justice William Renquist before he was appointed to the United States Supreme Court.

My goal as a lawyer, first and foremost, is to fight for my clients rights civil rights and obtain the best result whether a favorable disposition, a dismissal or an aquittal at trial. I want hel get my client's life back to normal as soon as is possible.

A good choice!
I hired Dan to defend me after being charged in a drug importation case at the border crossing from Mexico. Dan was recommended by an experienced, reputable attorney who told me Dan had much experience in the Federal Courts. When I contacted him he was personable, knowledgeable and informative. He has made one of the most stressful situations of my life a bit more bearable, and has helped me maintain as positive an attitude as possible under these potentially life crushing circumstances. I am probably not the easiest of clients and his patience with me has been exceptional. I have not yet been sentenced, so I am praying and hoping for a miracle. I do have faith that Dan will create the best possible outcome, and I will update my review at my case's conclusion. But for now I would certainly recommend Dan for any Federal Drug charge you are facing. He's not cheap, but quality seldom is, and I believe with his experience he will be worth the cost. If you have made some bad decisions and you find yourself in my unenviable position, Dan is a good choice. And best of luck to you and your outcome.

Made Miracles Happen!
I was facing a 10 year mandatory minimum conspiracy indictment which involved camera pole surveillance, wiretaps and everything else you can imagine. My criminal past was nearly non-existent but could have still muddied my case. Dan was positive, encouraging and worked hard to not only enable me to bond out until sentencing but because of the relationship and reputation he has within the federal courts here in San Diego, this may turn into a time served issue. Because of him, I am now at home with my family rather than in federal custody. Thank you, Dan!

An Outstanding Lawyer
I highly recommend Daniel M. Smith of the San Diego Defenders to anyone having trouble with the law, as was the case with my son. I believe that Mr. Smith is an outstanding lawyer. Mr. Smith took a great deal of interest in my son's situation, and did a significant amount of research to build a case to help him, which led to a sympathetic response of the court, and to a large reduction of his sentence. In addition, he provided a great deal of encouragement and moral support to my son and to his family. I think that my son was lucky to find such an excellent lawyer.

The San Diego Defenders Law Office saved me!
We all make mistakes and I am no exception. I was charged with Felony DUI with injury. This was my first time every being arrested and I was terrified of what the consequences would be. I searched for a good local lawyer and was pointed in the direction of San Diego Defenders law office. I called and arranged for a consultation. I met with Dan Smith and he was very honest and patient with my questions. I decided to retain their services. I was represented very well by Jon Pettis. In the end I was faced with fines, scram (90 days), 3 month DUI class, probation and 10 day public service. This was much better than the alternative of 2-4 year prison sentence. The office was responsive to inquiries and responded quickly. I hope to never need their services again, but if I ever find myself in a legal bind again, I definitely will be calling on the San Diego Defenders!

Felony DUI's are always tough. The prosecutor (and the judge) usually want to give you actual jail time. In your case, Jon and I came up with a plan to successfully challenge the "injury component" that is an element of a felony DUI (with injury) offense. Our motto is to leave no stone un-turned. When we reviewed the body worn camera video, there was no evidence of a substantial injury to warrant a felony! One of the reasons we charge a flat fee that covers legal motions and trial, is that we will look for ANYTHING that will help our client. They know we mean business. Felony DUI dismissed!

Provided me with information that I needed over the phone. Great attorney had a client too and made the time to give the info that I needed. I definitely recommend him.

I appreciate the vote of confidence. I do answer phone calls myself, although I am not sure which phone call I was responding to. In the end, I am happy I could get you going in the right directions.

Glad I made the right choice in calling San Diego Defenders office.
If you are reading this, it is probably because you are doing what I did a little over 9 months ago, and that is surf the net for reviews on a good Criminal Defense Attorney. I was looking at four (4) Felonies and One (1) Misdemeanor, which meant jail time for sure. I was worried, petrified, and uneasy it all added up to considerable amount of stress. I drove by San Diego Defenders office almost every day, not realizing that I would need to contact them. During my first meeting with Mr. Daniel Smith, I felt a load off my back, my stress level reduced, because he was going to work on keeping me out of jail. He did not make any promises, but showed me that he was confident on his criminal defense skills, along with his Partner Jon Pettis, very knowledgeable and they work well together. Dan and his partner have a good relationship with the DA’s office, and Courts (I think that is very important). They knew the right people to get my case reduced, stay out of Jail with a low risk case; they also worked out a payment plan with the court. I was happy with the outcome and glad I made the right choice in calling San Diego Defenders office. Good Luck!

Thank you. And again, this is a case that could have gone way South if we did not have a good reputation as litigators with the prosecution. That is, mutual respect can lead to a great negotiated result. We know a lot of the prosecutors and judges. When they know that your firm is the real deal and not a lawyer practicing out of his or her car trunk (that only is cool in the movies), that is a good place to start. I always tell potential clients to look at CA State Bar Attorney Search and find out where the lawyer is based. If the firm is not local, the results can be less than stellar. We have been in San Diego County since 1990 and that is local! Dan

Definition of Legal Tenacity
Daniel Smith is the definition of legal tenacity. My immigration case was complex. He worked diligently for over two years. With his extensive knowledge, he was able to exhaust all avenues and obtain a winning solution to my situation. Thank you San Diego Defenders!
Response from Daniel Smith June 22, 2018
Thank you! You might find it interesting to know that I talked with an agent of one of the ABC "agencies" yesterday. And it turns out that the officer that inputs the record probably "mis-recorded" the actual incident and he or she can go in an make a change. But when 29 years has gone by, it makes it difficult to locate the author of the record. After 28 years you might think you have seen it all. But that is never the case and that is why we have to latch on like a Bull Mastiff and keep on going. I am super glad we could clear your record of something that never happened. It can cost people their jobs and that is what I stressed in your case. Irreparable harm to your reputation and that is, in my opinion, what made it real for the reviewing agent! Dan

Excellent representation for DUI
Mr Smith represented me well, kept me informed along the way, help keep me calm and confident in unknown territory. Furthermore, when questions arose he took my call and answered all my questions. He made it easier to afford by offering a payment plan.
Response from Daniel Smith April 23, 2018
Thank you. Jon Pettis and myself, Dan Smith with our paralegal Layla Smith truly really want the best for our clients. That is why we limit the number of cases we take each month and we are willing to litigate and go to trial enthusiastically which is not common these days! Reputation to fight for our clients helps us to settle the cases to our clients benefit! Thanks for your review!

Ok. I am a very hard working technical professional always rushing to the next job. I was in a hurry a couple of months ago and received a speeding ticket. Daniel Smith represented me and was able to get the whole thing dismissed. Daniel's representation is unsurpassed and you need to call him today. His experience and track record is what you need.

DUI case
The case was dismissed. Mr. Smith was very helpful and answered all questions throughout the entire process.
Response from Daniel Smith September 22, 2017
Thank you for the review. Cases can be dismissed for a number of reasons. But in this case it was unusual because we maintained the same defense throughout the case. This was a clear case where the prosecutor realized that there were two problems they could not overcome. First, we had a great defense. Second, they were up against San Diego Defenders Dan Smith and Jon Pettis. We try cases to win and they know it.

Took care of everything!
I retained Mr. Smith to help with a legal matter with my son. Since I live in Texas, I needed someone in California to handle matters. Mr. Smith took care of everything and had my son's case dismissed.
Response from Daniel Smith September 7, 2017
Thank you for taking the time to comment. Your son's case was and is important to his future and we, at San Diego Defenders take a "Baby Duece" VC 23140 as serious as a VC 23152(A). All background checks, whether military or civilian, bring up old cases due to the new data bases out there. So it is VERY important to get cases DISMISSED when we can. We had a plan and your son followed instructions well. Smart clients are a real plus when it come to obtaining the goal of dismissal! Marines, Navy, Army any of the armed services are getting to the point that a slip up may lead to an early admin separation. So for anyone out there that is facing a criminal charge on base or off base, give us a call and myself, Daniel Smith or my partner Jon Pettis will do our level best. You will always get a friendly voice of certified paralegal Layla Smith on the phone and we will get an appointment or handle the retainer with a payment plan over the phone. We want to help. We have egos too! We want to win every case! Thanks for your kind words. Dan

Great Team
My husband was Involved in a DUI accident with injury. We were very afraid of consequences and a possible bad criminal record. I found Mr. Smith through yelp services online. I like most people are, was skeptical about anything to do with any attorney or lawyer. I called for an appointment and we met with him after. Very on point and straight foward. Mr Pettis his associate Attorney handled most of my case, very nice man and smart. Fought long and hard for our family, we appreciate him very much. They know their way around the court and are well known by court staff. Altogether I would give San Diego Defenders a full 5 Stars for excellence and honesty.

Response from Daniel Smith September 7, 2017
And what a case this was. A happy ending after some real gut-wrenching moments. All it takes for a misdemeanor DUI VC 23152 A to go to a felony is for someone to grab the back of their neck and say "it hurts!" and all of a sudden, the complaint changes to a VC 23153(A) felony DUI with injury. We fought the prosecutor on what exactly the injuries were and what made them substantial. The prosecutor and the judge finally sided with us. But the real problem is that, as a private lawyer, you can appear for your client in a misdemeanor. But when the DA changes the charges, all of a sudden, the client needs to be present or a warrant is issued. That is why we always call the DA a day in advance when there is an accident involved in the case to make sure it has not been filed as a felony. Important stuff. We get calls from defendants that find out the hard way that their DUI lawyers are not so experienced as the "founder" of the firm and they do not know what to do and the founder is no involved to any great degree in the case. At San Diego Defenders, I myself, Daniel Smith, have 27 years experience, my partner Jon Pettis has 21 years. We are the only 2 lawyers handling the cases. Period. And better yet, Layla Smith has been a criminal defense paralegal for about 18 years so she knows who to call and we do our best to avert problems. Also, it is important to take advantage of experience when negotiating, as we did in this case and got credit for time served that helped our client immensely since the DA caused the problem in the first place. Getting the best results sometimes means knowing who you are dealing with, whether a judge or prosecutor and knowing when to pull the trigger on the case. Timing is everything and we got this case reduced from a felony to a misdemeanor and got our client released immediately. Results! Felonies are bad news when you have a family to raise. We answer every phone call and get answers to the family on the spot. Teamwork got us a great result and we are happy for our client on this Felony DUI in San Diego reduced to a misdemeanor. That is why we call ourselves the best DUI lawyer team in San Diego. Two lawyers (and a great paralegal) for the price of one AND a payment plan. Where else can you find that? Thanks for letting us help you and your husband take care of your beautiful young family!

Bogus DUI Averted
I was riding in the passenger seat of my friends car. We were pulled over by the police claiming we hit the median of the street. I was subsequently charged with a DUI even though I was the passenger and the drive was stone sober. I hired Mr Smith and Mr Pettis to defend me and they did an excellent job of persuading the DA that the charges were bogus and the case was dismissed. They were extremely professional and personable. I felt that the case was in great hands and I was proved right. I would highly recommend them and would go to them immediately again if needed. Their rates are great and they went out of their way to help us out even further in that area. Once again highly recommended - Michael (Satisfied Client)

Michael, Thanks for your kind words. It is important to note that we took this case all the way through the system and set it for trial before the District Attorney caved to our demands and were given our investigation notes concerning the witness. This case was a real win for us too! We feel the DA has respect for our trial skills in litigation. Dan

Amazing Lawyer
My case started as a Misdemeanor Battery in October of 2016, it involved pepper spray and the other party placing me in a private persons arrest. During the initial contact with the officer I was asked about my dashboard camera. Unfortunate for me the officer took my dashboard camera as evidence against me. When the officer filed the paper work with the court he changed to charges from a Misdemeanor Battery to a Felony Illegal use of tear gas weapon. It was bad and I needed help fast. I had been doing research on local lawyers and decided to pay only two a visit. The first was flashy with her nice place and weird way of doing business. It felt very impersonal and made me feel like a number. I decided to take my business with San Diego Defenders. I made contact with San Diego Defenders over the phone and left a message with their answering service. I was contacted by Daniel Smith from San Diego Defenders. He got right to the point and asked me to come in for a chat. I was hesitant at first because I was not given permission to talk with the other attorney's I only spoke with case managers. So I went in to further discuss my situation. I left San Diego Defenders feeling great about my decision. As of January 2017 I am happy to say that the DA decided not to file charges against me and my life is back on track. I am forever in debt to Dan, Layla and Jon for all their help in my case. If it wasn't for the hard work from San Diego Defenders I would be in prison unable to return the favor in this small review. My monthly bill with Dan Smith comes in at a whopping $150.00 per month. If you are hesitant about conducting business with San Diego Defenders I ask that you take a deep breath and handle your business with people who are willing to go above and beyond for those they defend. DO NOT HESITATE, go in, speak with Daniel Smith FACE TO FACE, not a case manager and hear it from the horses mouth. YOU HAVE EVERYTHING TO LOSE IF YOU ARE NOT WORKING WITH Dan Smith, hire only the best at an affordable price. Thank you Dan, Layla and Pettis! All of you are amazing people doing great things to help those in need. I can't thank you enough for all your hard work and dedication to my case. I am forever in debt to all of you. If I am ever in a bind again, San Diego Defenders is my go to Law Office

Response from Daniel Smith September 7, 2017
I am late commenting on this case, but I had to! This was a bogus charge that was brought by the San Diego Port Police using code sections for assault and another specifically for use of pepper spray. The fact was our client was acting in self defense and we were not going to let him get shoved into a crime of violence that would end his job as a Lyft or Uber driver as soon as a background check was ever done. We had to beat it and we knew it. Myself, Daniel Smith, supervising attorney and Jon Pettis, my partner, worked this case until we got it dismissed. When a law firm has a reputation that they do not back down, and that IS our reputation, the prosecutor knows that we are good trial lawyers and we win cases. Bragging? Maybe a little, but it is true. We took a payment plan that is even lower than usual because our client impressed us as being a straight up guy. That is also why we do not quote fees over the phone, because we want to meet you and get an impression of who you are. Not all cases are the same and not all clients are the same! Call us and set an appointment. If the lawyer wants to quote a fee over the phone, beware! That is kind of like a auto body shop saying we charge the same to fix any fender on any car, Huh? How can you do that and do a good job? We want to continue to earn the reputation as the best criminal defense lawyer team in all of San Diego! Dan

FELONY DUI DEFENSE
Mr. Dan Smith represented myself in a felony DUI with additional child endangerment charges. I was facing one year in jail since it was my second DUI . My case drug out for over two years and Mr. Smith and his team stuck right by my side the entire time. I paid one flat fee for his teams services. His team did such an outstanding job defending me throughout the entire process. He negotiated and fought for me using his years of experience and kept me out of jail and only on probation at the end. He also continued to represent me when a restitution hearing was brought against me for the same incident with no additional fee. Mr. Dan Smith and his team represented me very professionally and his teams action resulted in a second chance for myself. I owe my freedom to his law firm. This is the second time I have used Mr. Dan Smith and his team and I would use them again if ever needed (let's hope not).

THE BEST
My son's case was not as involved as most Attorney Dan Smith represents. My son's two pieces of luggage were seized at the border near San Diego by CBP. He was sent over 2,000 miles to his home area but his luggage was left behind with CBP saying they will be destroyed in 30 days. After a couple of weeks of failed attempts on my part to have the luggage returned, Mr. Dan Smith was able to get favorable results in less than 24 hours and send the two pieces of luggage to my son at his home address over 2,000 miles. Although most of Mr. Smith's cases are much more involved, with serious life changing consequences than this one, he knew how important it was to my son and me for the clothing, etc. be returned. He is caring, competent, and professional. I wish he was located in my area. San Diego is very fortunate to have Dan Smith, attorney, in their area. I will always be grateful for his services. For me, Mr. Smith was a Godsend.

"I endorse this lawyer. Dan Smith is one of the most skillful defense attorneys I have known in my 15 years of practice in San Diego. When you add to that how sincerely concerned about his clients he is, it is a combination that makes an excellent advocate. Whether it is negotiating a plea or taking the case to trial, I would tust him to handle any criminal matter."

"I met Mr. Smith while I was an intern at the Chula Vista, CA courthouse. Mr. Smith taught me the proper way to present myself to the court, not just the rote, what to say, but more importantly how to say it. Every case I had the pleasure of watching Mr. Smith work on highlighted his care for his clients, respect for the profession, and excellence as an attorney. I highly recommend Dan Smith."
