Daniel Scott Moffatt

I am not one to post negative comments about anyone... However, I want to warn everyone about Daniel Moffat. We all understand car salesmen are not trustworthy and many attorneys fall in this category, Dan is all about maximizing $$ Facts... He only has 9 comments and most are close to 10 yea...rs ago. Based on my unfortunate experience he is clearly more about doing what is best for his pocketbook. I used Dan for a DUI case in Long Beach. Dan stated that he has previously worked in the LB courthouse and very familiar w the judges. During one court visit I asked Dan to delay the case as far as possible. The judge offered a 45 day postponement. Dan to my disbelief told the judge that he wanted an earlier date to accomadate his schedule. I was in disbelief and questioned his commitment to my defense afterwards. He made excuses. Imagine an attorney that refuses to listen to a simple request of a client to better serve his interests. My main goal was to receive house arrest vs jail time. I made this very clear to Dan from the very beginning. Dan is about doing the least possible including the minimum amount of court visits. Dan repeatedly told me that the judge does not allow house arrest. What Dan did not tell me is that if we continue to plead not guilty the case will be move upstairs to a different judge. Not once did he ever mention this. Why.... because it would require more of his time. Dan was about his client accepting the minimum court offer of 6 months in jail.. After paying Dan $6,000 and no effort to negotiate house arrest I made the decision to fire Dan as legal representation. I instead chose a public defender. The public defender accomplished what Dan told me was not possible. My case was moved upstairs and the public defender negotiated a 90 day house arrest. We all make mistakes in life. However, wasting thousands of dollars on an attorney that is driven by money vs truly caring about their client is a terrible feeling. I recently asked Dan for a partial refund and he never responded. Please think twice about using this person to represent you. I made the mistake of choosing Dan for my representation.

In the end, I deferred to his judgment and am glad I did. He was spot on in his priorities and positioned the case perfectly to my advantage. When you have a good attorney, trust him. That was the lesson I learned in this case. In court, Dan ran circles around the opposing counsel, catching them in numerous mistakes. As Dan went to work on them, the judge grew increasingly skeptical of the petitioner's claims and impatient with the opposing counsel. In cross examination, Dan was relentless in exposing the petitioner's inconsistencies, while always maintaining a dignified, composed demeaner. Thanks to Dan's skill and experience, I won the case and have no record of domestic violence. I was concerned that this matter would affect my employment. Now, I have such a sense of relief because it's all behind me. I hope I won't have to hire a defense attorney ever again, but if I do, I know exactly who to hire: without hesitation, Dan Moffatt.
