Since it is not appropriate to discuss the facts of a specific case, I will not. I will give some general advice to potential clients and/or those seeking legal assistance from ANY lawyer. If an attorney is honest and tells you your chances of getting what you want are slim to none but you don't want to hear that, or don't believe it - don't waste your money on an attorney. Either represent yourself or rethink your case. Or go get other opinions. You can usually find someone who will tell you want you want to hear. You always have the option of NOT hiring an attorney who gives you an honest opinion such as -- "You're going to lose this one." With that knowledge, if you choose to retain me, I am going to fight for the most I can get you, I am going to fight the good fight. But don't hire an attorney if you don't believe me/him/her from the start. And if you are given effective steps you need to take in order to bolster your case and you opt out of exercising those steps, you have shown poor judgment. If we have settlement around 10AM but you want to "fight" and we're at court negotiating until 3PM, (a) I am billing; and (b) I am not accounting the depletion of your retainer at 12:35PM at the court house. I do that in my office on the computer after the fact. But I give all of my clients my hourly rate and method of billing. There is no reason not to know the difference between one hour of my time versus six hours of my time. If you hire any attorney and you do not know how they bill - demand that information or move on. Finally, If you decide to lie to your attorney and also lie under oath and opposing counsel provides documented proof of your lies and/or contradictions - I am still going to fight for you and try to mitigate the damage you have created. Sometimes the fight is better left between the lawyers - not presented to the Judge. But when you don't appear before Judges on a regular basis you cannot know this. So it's all in the knowledge of "having been there." I and other attorneys are often required to protect our clients from themselves. And that is often a thankless job. But I meet the task with vigor and zealousness.
