We had to dismiss the first case and start anew. We were not daunted by two years of delay tactics, substitution of attorney by the other side, and failure to respond to our requests. After "settlements" that failed we went to trial and my client is ecstatic that he has this weight off his shoulders. He could not be happier and neither could I!

OUTCOME: Win for Debtor wrongfully evicted after violation of automatic stay
My client, a debtor in Chapter 7 Bankruptcy, had lost his job, spent every dime he had to save the family home. He finally had to file bankruptcy when the home was sold while he was still in a loan mo...dification! The day after Debtor paid the bank $15,000 that he had to scrape together via friends and family and savings -- he was assured by the bank representative that his loan mod was moving forward successfully but his home was sold!! He could have used that money to move! He dealt with the new owner in good faith attempting to negotiate an extended move out and/or relocation fee. The new owner strung him along and then improperly served him with an Unlawful Detainer action. After new owner was notified of bankruptcy filing (which imposed an automatic stay on new owner, preventing him from taking action against my client), he -- the new owner -- had the Sherriff kick Debtor out. It was malicious and spiteful. New owner purposefully ignored the law and admitted it, wrongfully removing debtor, debtor's wife, three children and dog on a Friday AM before a 3-day Holiday week-end. I was phoned at 8:00AM while still having my coffee and jumped into action. By 3PM we had written, filed and personally served an Order to Show Cause on new owner and, at our hearing the following week, Debtor was allowed to move back in to his home to retrieve his items. He received damages and the Judge was prepared to allow me to recover attorneys' fees and costs. I gave up my attorneys' fees and costs in exchange for Debtor getting more time to move out. Less money for me, more time for Debtor to move his entire family. We are now good friends and I am honored to know he and his family. But the absolute best moment was getting to my office to hear the message from Debtor's young son thanking me for getting them back in their home. Made my eyes water and made my day!

OUTCOME: Case decided in my favor with full relief requested, reversal of accusations and complaints filed with Attorney General and OCC.
My ATM card was cloned and password stolen. The withdrawals occurred while I was working in a Law Firm so I had signed in the building during the actual withdrawal. Further they were significantly ou...tside of my traffic pattern and I had never been to either of the ATMs, EVER. Chase rep at my local bank promised a return of funds within 24 hours. Not only did they not return the funds, they later accused me of compromising my card and harrassing collection calls began. The first rep who spoke with me at the bank would no longer speak to me. I had collection calls coming from Texas, Florida and who knows where. I had no choice but to sue.
