Fortner is a complete moron.

Fortner represented my ex-wife in a child custody case. He was so oblivious to the specifics of the law that he did not know that he could have filed in Prescott instead of Phoenix. This cost his clients thousands of dollars in time/expense related to several commutes to/from Phx-Prescott. He also... lied several times during our case; and effectively botched virtually every aspect of representing my ex. This made the case a complete cake walk for my attorney, who effectively mopped this floor with this aged fool's toupee.

As your ex-wife, you and your children were residents of Maricopa County venue was proper in Maricopa County. Filing in Yavapai County would have clearly been improper and would have resulted in unjustifiable delay and expense in a case where all the parties and most of the witnesses lived in Maricopa. A friend of your ex-wife's family provided transportation back and forth to Phoenix from Prescott and I did not charge for travel time. I am not perfect but I have never lied to a court and cannot remember the last time I lied to anyone and never to a client or an opposing party. I believe you are a good person from a good family and a great dad. What I tried to point out to the judge was that you were understandably upset at the breakup of your marriage and were using your superior economic position to punish your ex for leaving the marriage and were engaging, perhaps without being aware of it , in alienating your children from their mother. I have been around long enough to understand that no one outside of a marriage really knows what goes on in a marriage. It has been years since I represented your ex and I do not know what is going on now but when I last represented her she had custody of your children and your had liberal visitation. I do wish you well.

I lost my house due to his negligence

Stay away from this guy. I hired him to file a BK when my house went into foreclosure in 2003. It was a procedure to buy time while I accumulated funds. My BK was rejected by the court because of mishandling by my attorney. The mishandling was the result of his assigning the BK to his daughter to... administer who worked in his Camp Verde office and had no clue of BK law. The result was my home being sold in foreclosure. After his complete failure to perform as my attorney, he failed to relinquish $1500 to me that was deposited to the court on the foreclosure, saying that I 'owed' him for the BK.

Without a case number it is hard to be specific but he acknowledges that the bankruptcy was filed by him to obtain time to raise money to fund his Chapter 13 reorganization. There is a limited amount of time to present a plan to the Court which I can attempt to get extended but after the filing current payments must be made on the client's mortgage and a plan has to be submitted and funded in a timely manner. It is sad to see a person lose their home but if you cannot pay for it there is no magical way of keeping the bank from taking back the security for their loan. I could not delay the foreclosure without it being funded by the client and this he could not do.
