I have been practicing law since 1993, in pratically all areas from divorce and paternity, modifications, criminal defense, personal injury, probate, general civil litigation, and the llke. As a young lawyer, I started out taking any case that would get me in front of a jury. I knew I wanted to be a trial lawyer. I wanted to be comfortable in the court room. So, I tried all manner of criminal cases, civil contract cases, and personal injury cases. I started my law practice in Maine. After 10 years, I had twin daughters and moved to Salt Lake City, Utah. Since that time, my practice has focused on divorce, paternity and family law, and some criminal and civil law. I now have a son as well. My husband and I live with our three children and three dogs in Park City, Utah. We love to ski, hike, play baseball, softball, soccer, and any other sport that involves the outdoors. I have my own practice now, having practiced in small firms to large firms over the years. I find my joy in my family, and in helping my clients through some of the worst times of their life. The best part is the fact that they move through a process, and hopfully, at the end, continue to move forward in a more positive way. I have watched a spouse, mother or father, collapesed by divorce or separation, find love again, connect with their children again, and find their own joy again. I am grateful for those clients that stay in touch with me so I can share in their happiness.

Divorce
Emily strongly represented my interests and the interests of my minor child and even, ultimately, those of my young adult children. She listened to my goals, worked in accord with my ambitious timeline to dissolve the marriage and applied both her legal skills and social perceptiveness to critically ...

I went through a divorce and it was nasty on his part and Emily helped me through the whole thing calmly and very professionally! She knows what she’s doing and you can tell she loves what she does! She’s incredibly smart and very protective and professional! She helped me get through a nasty divorce...

Exceptional human being, exceptional attorney
Emily has been my attorney for the last 12 years. I don't think either one of us thought my divorce would be the treacherous and vindictive struggle that it was. Who knew that in 12 years I would be in court 3 different times for a single divorce. Through Emily's thoughtful and common sense counsel...

Emily Smoak is hands down the best choice
My wife hired Emily to help her end an ongoing custody battle between her and her ex. I've stood beside her and watched as Emily gracefully navigated through that mess. Some attorneys pick battles and belittle the opposing side out of arrogance which unfortunately prolongs the fight. Emily has the se...

She could have been worse
If you're at the beginning of your divorce process you're probably a little scared and looking for someone who can give you advice and who you can trust. At first Emily seemed like she was exactly that and during my free consultation with her she came across as someone who would fight for me and prot...
To anyone reading this comment, I want to add some context to Ryan's complaints. I sat with and advocated for Ryan for 11 hours during his divorce mediation. He left mediation fully satisfied with the signed settlement agreement we reached on his behalf. The Divorce was entered April 27, 2021. Ryan failed to timely pay his financial obligatons as he had agreed to do and as he was ordered to do in the Decree of Divorce. Months later, on June 21, 2021, opposing counsel filed an action to collect the monies that Ryan should have paid. Although my office offered to help Ryan with the civil action for failure to pay, Ryan refused our help. Ryan then posted this negative review at the end of August 2021. I hope you find this helpful. Best, Emily
"I endorse this lawyer. Emily is one of the most professional, intelligent, hard-working, and successful family Lawyers in Utah. I have had the pleasure of working with her on a number of cases. Whenever I have a case against Emily, I know I have got to bring my best work because that’s what I always can expect from her. If Emily is your lawyer, you have made an excellent choice."
"I have worked with Emily as opposing counsel on several cases. She is a strong advocate for her clients while also being collaborative in nature. She is a pleasure to work with. I endorse this lawyer."
"Emily is an excellent and personable attorney attorney with a passion for assisting her clients. I have co-counseled with Emily on multiple matters and often consult with her. She has an excellent command of the law, and more importantly, is a common sense problem solver. I confidently recommend her to anyone who needs legal services in her areas of expertise."
"Emily has a very pleasant style. She is reasonable and diligent and works well with other attorneys. We were able to resolve a difficult case due to her openness and good communication skills."
"As a colleague, I would say that Emily's distinctive feature is that she is very easy to work with. This character trait is essential to being able to settle a case with an opposing counsel generally. In the practice area of family law -- where emotions run high and opposing counsel are ofttimes difficult -- I find Emily's approach to be a breath of fresh air. For that reason alone I think she is an impressive family law practitioner. I have also discussed various cases, colleagues, and court staff with Emily on occasion, and Emily appears to be well versed in family law practice and procedure. Emily is a wonderfully supportive colleague."
"I 100% endorse Emily. She has the intellect, practical knowledge, and exceptionally calm personality that makes her the perfect attorney to represent you during a difficult time in your life. She is brilliant both in her understanding of the law, and on strategy that serves her client's well. I would not hesitate to hire her to represent you. She is excellent."
"I endorse this lawyer. Emily is knowledgeable and professional. A true pleasure to work with. If you are in Utah and have a domestic matter, I recommend that you give Emily a call."
