My co-parent (ex-spouse) and I went to Ms. Dalton to make a modification to our divorce decree that included child support and parent-time adjustments. Though the process is typically difficult, my co-parent and I had reached an agreement in principle on our own prior to seeking mediation. Ms. Dalt...
This was a case I accepted at the last minute, and one that I did not properly pre-screen. The parties had a history of divorce litigation and had required attorneys in the past to resolve their differences. Nevertheless, I was successful in assisting the reviewer and his co-parent reach a settlement in mediation and provided them an opportunity to file their own Stipulation as "pro se" parties. A problem arose when the reviewer was not satisfied with the language I recommended for his and his co-parent's Stipulation. After listening to his concerns and making numerous revisions, the reviewer rejected draft after draft of a proposed Stipulation. When it appeared to me that no language was going to be satisfactory to the reviewer, the reviewer's co-parent ended the negotiations concerning the "language" summarizing their simple settlement. The reviewer was also confused in understanding that a parent that earns no income, has difficulty filing a document "verifying income" as the court requires. This reviewer will experience more success resolving his legal issues by having an attorney represent him. Or, this reviewer can use the excellent "self-help" forms on the court website and compose "language" he likes for a "pro se" Stipulation and propose his version to his co-parent.
