Terrible Experience

What an interesting review; notice the lack of detail? The first phone call. This client left a message on a Friday evening indicating he had an urgent custody matter. When I returned his phone call the following morning, Saturday, he was too busy to talk stating he was driving and going “four wheeling.” Fortunately, a family member suggested he pull over and discuss his custody matter. Interestingly, this client knew that his custody matter was on a downward trajectory several weeks earlier, but delayed contacting an attorney. He went on to describe the custody issues, which involved a court case on Monday morning (yes, just 48 hours later). I informed him that I was unavailable Monday morning at 9:00 a.m. due to pre-existing legal matters, at which time he immediately became angry, resulting in me having to remind him that it was HE who didn’t even want to talk initially. This client represented himself at the first emergency custody hearing all with an open Children and Youth investigation pending. The following week while I was in Court with other clients, yes, actually in a courthouse - either in a courtroom or on a bench with a paying client - this client repeatedly demanded that I contact him immediately. I deem this to be inappropriate. When he did not receive an immediate response from me, he became further agitated. I even had to explain to him later that evening that, if I was in Court with him, he wouldn’t be paying me to be discussing other matters down the hallway on my cellular phone. Subsequently, during yet another phone call, this client stated, “I don’t trust the legal system and you’re a part of it.” Thereafter, I explained that a client and attorney need to be on the same team and that it was clear that he viewed me as his adversary. Despite this client wanting to continue with representation, I terminated the representation. Here are the takeaways: always make your case a priority; do not engage in self-representation, especially where there are complex legal issues; it’s okay to be frustrated but know that your attorney is on your team even if the facts or laws are not; and finally, know that a reasonable time for a return call is the same day or the following day. Expecting an attorney to respond to your communication when with another client is inappropriate and unacceptable.

Heidi was the first lawyer I’ve ever spoken to. During our initial consultation, she acted as if she’s heard everything I said before, constantly cut me off, & when I questioned her responses said things like “you’ve seen my reviews” as if that made her superior to others & made me feel like my conce...
By the time this former client scheduled with our office, she had already represented herself at a custody conference in Lehigh County and immediately acquired "buyer's remorse" for her electing to do so. Therefore, perhaps I was the first attorney that she spoke to. Once the Custody Order was entered by the agreement of our client and the father, only then did she decide to consult with our office and unfortunately as some litigants seem to do, expected us to undo what she had agreed to without representation. During the consultation, she was informing us as to “how it is” as though she is an attorney (probably the reason why she elected to represent herself in in the first place). Immediately upon retaining our office she began questioning every charge that would later become a part of her bill. Nevertheless, her old custody issues and concerns and the updated custody issues were addressed at a new custody conference wherein she was represented by my associate due to an emergency. As a result of the hearing, she maintained primary custody (a significantly positive outcome hardly resulting from my associate not speaking during the conference) and she even hugged my associate as the two of them left the Courthouse. As it turns out, a review of the docket seems to indicate that the father has now filed for a modification of custody. Apparently this former client is now frustrated and needs an outlet for her anger and on-going legal fee expenses. In any event, my recommendation is to have legal representation from the outset of your custody matter. Attorneys are not magicians and therefore cannot magically undue the things that may have resulted from proceeding into conference or hearing unrepresented.

Do yourself a favor and find someone else
I hired attorney Noll for my child custody case based on the reviews I read here (which I now see are years old). She was very polite when I first consulted her and made it seem like my case was going to be a piece of cake. Well, as time went on she just got more and more rude with me, never answered...
You will note that this anonymous client doesn't share with you what work I was hired to do that I did not provide. Sometimes attorneys and their clients develop philosophical differences in the way their case should be handled. Once this occurs, the attorney typically notifies the client that they will be withdrawing from the case. An attorney may withdraw from a case for a myriad of reasons. A contract for legal services typically also provides that you as the client has the right to terminate the representation by your attorney and seek alternative representation. In addition, most civil attorneys bill by 2/10 of an hour with minimum billing charges. These billing terms are also set forth in your contract for legal services also called a fee agreement. (Please review your contract for legal services for specifics). In any event, once I find it necessary to and inform a client that I am withdrawing from their case, other than to return the client's file, I do not interact with the client. I no longer answer calls. Furthermore, I will strongly instruct the now former client not to contact me or my office because such communication would serve no purpose.

Please be aware that it is not atypical to contact the other party if he or she is unrepresented or opposing counsel if the party is represented. Contact is often made via phone or correspondence for a variety of reasons including, but not limited to, obtaining the opposing party’s perspective, or even discussing settlement if in fact settlement would result in a satisfactory outcome for my client. Contacting the opposing party should never be viewed as disloyalty to my client. This nameless client is interesting because a variety of unilateral actions were taken prior to the client consulting with any attorney much less consulting with me including vacating the marital residence and leaving personal effects behind. As my reviews indicate, I am highly prepared for every case so I’m not sure what the word “adequately” denotes. To the extent that there is any “hearing” or “trial,” I am diligent in my preparation of cross-examination of the opposing party, as well as, a review of the evidence in order to competently address the deficiencies in any evidence which is presented by the opposing party. Please be aware, often times clients enter into an agreement to settle their case but acquire “buyer’s remorse” later when it is impossible to modify the agreement which they entered in to. Please give considerable thought and consideration PRIOR to entering into any agreement and recognize that while costly, you may always proceed to trial.
