I was charged with DUI and child abuse after a questionable pull over by a state trooper who exaggerated every aspect of the situation and then was unable to recall his inaccuracies under cross examination. I was involved in a very unusual DUI stop and arrested based on suspicion of a DUI-D. I cooperated and agreed to a Breathalyzer test as I had no alcohol in my system and despite having a recent spinal fusion, agreed to the roadside maneuvers which I did poorly on. I was than asked to provide a blood... test in which I refused based on a grossly misadvised refusal consequence. A refusal in Colorado is an automatic suspension of your drivers license for up to a year with a mandatory vehicle interlock device placed in the vehicle for two years, Things were not looking good for me. As a single Mom and Realtor, I could not afford to lose my license. I had a DUI case from Illinois in 2003 that was sentenced as a court supervision. After the court supervision was completed it was recorded as a conviction. Earlier this year I received another DUI in Colorado. This was treated as my second DUI, however I did not know it would be in court and told... the judge that I had only one prior.
