The trial court’s judgment is affirmed annuling the Decedent's marriage on the grounds of mental incapacity in a post-death annulment proceeding brought under the Estates Code. Appeal No. No. 04-15-00461-CV; opinion delivered August 31, 2016
Hon. Kelly M. Cross entered judgment on the jury's verdict finding that Decedent lacked mental capacity to enter into a marriage and entered a judgment of annulment.
Following a 6 day bench trial, judgment entered in favor of Plaintiff/Tenant, awarding declaratory, injunctive relief and $180,000 in attorney's fees and case expense
The 4th Court of Appeals affirmed the Trial Court's judgment enjoining acceleration of the Note and foreclosure proceedings and awarding attorney's fees in the amount of $240,000. Case reported at 468 S.W.3d 557 (Tex.App.--San Antonio 2014, pet. denied)
Judgment affirmed and petition for review in the Texas Supreme Court denied, 426 S.W.3d 800 (Tex.App.--San Antonio 2014, pet. denied).
On competing motions for summary judgment, trial court (Mickey Pennington) ruled that foreclosure was improper, that Schuhardt had breached the terms of the Note and Deed of Trust and awarded $240,000 in trial/appellate fees and case expenses.
Judgment in favor of Double Knobs Mountain Ranch enforcing the 1979 Easement and awarding attorney's fees of approximately $146,000.00 through the date of appeal, if any.
Easement dispute settled in which the Property Owner's Association recognized Buyer's right to access his adjoining land through the subdivision's roads.
Verdict for Nilesh Enterprises in the amount of $650,000. Case was settled on the verdict while Nilesh's application for an additional $300,000 in attorney's fees and costs was under consideration.
