"Richard" - thank you for leaving a comment. As I have not represented someone with this name in a number of years I am having trouble responding to this comment. As you know, any agreement or result leading to reduction of an actual higher charge required YOUR agreement. I will never and would never allow a client to plead guilty without their consent. We work hard to get the best possible outcomes for all clients. The outcomes are often case specific and based on the allegations and the facts. Thank you for your comments. I can appreciate your concerns and certainly will work to address them with you and to explain the billing and progress on this case. You hired us after an erroneous ruling was made in a hearing (where you represented yourself) by the Title IV Child Support Court Judge in March of this year. At the first de novo setting YOU failed to bring required documentation with you, requiring the matter to be reset. Despite preparing for the hearing and going to court on your behalf you were billed a grand total of 30 minutes by my firm. Prior to the next setting you lost your job. At the next setting, the case was not going to be reached by the Court so the parties agreed to attempt a settlement by negotiations. Rachel and you sat down in good faith with the mother of your son and an available representative of the Attorney General's office to try to reach an agreement. One could not be reached and the parties broke negotiations at noon. [Despite Ms. Aguilar appearing for Court and an anticipated hearing at 9:00 a.m. and leaving at noon, you were only billed only 2 hours of attorney time and no time for her preparation prior to court that morning.] RESULTS: Negotiations continued, in earnest, on your behalf during which time we presented to you an offer wherein the Obligee Parent (Mom) agreed to (1) provide medical support herself (negating your obligation to do so) (2) reduce your monthly child support obligation, and (3) agreed to a pick-up/drop-off point for you to exercise visitation. An agreement would have resulted in a net savings by you of over $240/month and allowed you to exercise visitation with your son. YOU REJECTED this offer in late May and the matter is reset for another hearing in late July. Since that time, you have failed to pay this firm for all work performed and likewise failed to advance the necessary professional retainer required to proceed to the contested hearing you desire. We certainly do not recommend anyone accepting an offer with which they are uncomfortable. In a hearing the child support determination will be based upon calculations made based upon the evidence of income, employability and current income assuming the obligor is not intentionally under-employed. The court will also make an order for the obligor to provide medical support. We have since received notice from the Attorney General's Office that you are once again employed. Congratulations. If you would like to actually contact my firm to discuss this matter, I am happy to speak with you. It appears that the genesis of this post, as is the nature of child support matters, is money owed. I appreciate your concern. Attorneys and firms like mine work hard on behalf of their clients and strive for the best results. Again, I have always been and remain willing to address your concerns. Perhaps you would give me the honor of a call, or rather come meet with me [no further charge for our discussion] rather than a post not based on actual facts, but rather emotion.
