I do occasionally yawn; that is not an expression of disinterest or boredom, but due to the fact that I have two young children, one of whom has adopted the fun habit of intermittently coming into my and my wife's room in the middle of the night and whispering to me at our bedside (which had happened the night prior to this). I apologize that the impression given was a lack of interest. I don't sugar coat things. If the facts and laws do not support a desired outcome, I won't lie about it to be retained in a consultation. I believe it takes more integrity and courage to tell someone—client or consult—that they have a terrible case than to soft sell them into unproductive litigation. I apologize if your takeaway from our meeting was that there was nothing you could do, but we did discuss your options. I suggested steps you could take to protect yourself at the outset to ensure you could not be cut off from resources and unable to retain counsel or pay living expenses. We also discussed the fact that there was not much community property to divide due to the short duration of the marriage. We discussed that, under the Texas Constitution and Family Code, most of the assets would be the separate property of your spouse, having been brought into the marriage by your spouse. We discussed that there could be a reimbursement claim for the loan principal paid down during the marriage, but that the recovery would be small since most of the payments would be going to service interest and not principal. We also discussed that the longer the marriage went on, the more community estate would be funded for division, and that it is typically in the "moneyed" party's interest to "buy" a quick divorce to avoid funding the property division. I apologize you felt that I didn't care. I do stand by the advice I gave even though it wasn't what you wanted to hear. I hope this review makes clear that these reviews are, in fact, written by real people. I believe my other reviews, which were written by people I represented as opposed to after an hour long consultation, more accurately reflect that I care about my clients and, further, care more about providing realistic advice than pushing legal services.
