OUTCOME: NOT GUILTY
This was a case in which my client refused the breath test but took the standardized field sobriety tests. Fortunately the jury agreed with us that our client had normal use of his faculties.

This was a difficult case in which my client had insisted on his innocence throughout my representation. In a two day trial we were able to overcome the state's case consisting of five witnesses to achieve a hard fought NOT GUILTY VERDICT.

This was a total refusal case. My client looked good on the video and the basis for the stop was somewhat questionable, The prosecutor wisely chose to offer a bench trial. After the testimony of two ... witnesses, the Judge agreed with us and found my client not guilty.

This is a case where we had a pre-trial motion to suppress based on an illegal stop by the officer. The officer said he stopped my client for failure to maintain a single lane. Luckily for my client, ... the entire driving distance was captured on video. After seeing the video and listening to our argument, the Judge agreed that the officer did not have a legal reason for the contact and suppressed the stop. The DA was then forced to dismiss the case.

This was a great case for us. My client was pulled over for questionable reasons. He refused the walk and turn and one leg stand due to a back injury which we had medical records to support. The pro ... secutor offered a reduction to obstruction of a passageway, but my client rejected the offer. The prosecutor then decided his best option was to dismiss the case outright.

This was a very difficult case, but it was ultimately very rewarding as we were able to secure a NOT GUILTY verdict. There were problems with the breath test which we were prepared to attack, but we s ... eized an opportunity to prevail early by focusing on the questionable nature of the stop. The officer’s testimony on this issue was probably inconsistent because two different videos of the arrest were lost by the State. I was assisted on this case by Co-counsel James Baker.
