The biggest area of my practice is in the area of defending consumers from collection lawsuits. This includes suits by the oiginal creditor, or an entity that has purchased the debt, often for pennies on the dollar. I also handle suits where a consumer is being sued on a car loan after the vehicle has been repossessed. The bill collector has the burden of proof when they bring these suits, and they frequently lack the documentation neccesary to prove their case.

A Chapter 7 Bankruptcy is a powerful tool that can be used to liquidate many types of unsecured debt, such as medical bills and credit cards. If you are going through tough times you may be forced to decide which bills to pay. By liquidating those debts which can be discharged in bankruptcy, thus freeing up cash to deal with secured debts such as your mortgage or car note. If done in time a Chapter 7 Bankruptcy may allow the consumer to avoid foreclosure or repossession.

A properly executed will is the best way to ensure that the legacy that you leave behind is distributed according to your wishes and that your loved ones will be provided for as you desire. In addition, a good estate plan includes properly executed documents that state your preferences for electing someone to serve as power of attorney for handling your business and medical affairs in the event that you are incapacitated.

Probate is the process by which the courts grant someone authority to conduct the affairs of the estate, distrubute assets according to the will, pay the bills of the estate and so forth, then proceeding forward with handling the affairs of the estate. It is important not only to take care of the affairs of the estate, but a properly probated will may be essential to properly rest title to an asset in the beniciaries name in the event that the beneficiary wishes to sell that asset.
