When the attorney returns to practice, he or she will be on probation, meaning the State monitors the attorney's activities for a period of time in hopes that he or she will not repeat the behavior.

Spencer’s comment:

“The sole finding for sanctioning was that I had "failed to properly supervise a non-attorney assistant to ensure that her conduct was compatible with [my] professional obligations as an attorney." My new office had opened in Dec.'95. The assistant's "conduct" in question occurred over a five month span (01/96-05/96), while I was traveling back and forth from Dallas to NY to assist my mother during my father's terminal illness. My father passed in Aug.'96. I terminated the assistant in May '96.”
