I was disappointed in the communication between us. I apologized for not staying in touch and offered to file suit immediately. I originally offered to take her case on a standard contingent fee of 1/3 of total collected, but offered to do it hourly to see if it would settle. She choose to pay hourly and was charged minimally. She then asked to switch to contingent fee which I did and continued to work. Client kept promising others in her subdivision were similar to her and would be contacting me to join suit. We decided to file it with the others so the suit would have greater impact. I heard from some others, but none thought suit necessary. Client indicated more would be coming and so I waited. Apparently, I lost track of the case and apologized for not staying in touch. However, that swings both ways. Had she contacted me and said what's going on, I would have told her and she could have selected to proceed on her own. What compelled her to suddenly contact me I could not say. I even offered to send my work to her new attorney, but she indicated she was done with attorneys other than trashing me. I guess there's a first time for everything.
