Michael Robert Osterhoff

Michael Osterhoff is a partner with the firm's Patent Litigation practice. Michael focuses his practice on intellectual property litigation, with an emphasis on patent and unfair competition cases. He has first chair experience before federal district courts throughout the United States. Michael has experience litigating matters involving trademarks, trade dress, counterfeiting, trade secret misappropriation, false advertising and industrial espionage. He frequently handles emergency injunction proceedings as well as disputes brought before the American Arbitration Association.

In addition to intellectual property matters, Michael has significant experience in the healthcare industry. Michael has led investigations of improper competitive practices under healthcare laws and regulations and successfully brought claims of unfair competition and tortious interference. For example, in Ameritox v. Millennium, Michael helped secure a multimillion dollar verdict based on violations of Stark and Anti-kickback laws in federal court in the Middle District of Florida. He also provides counsel to clients on healthcare compliance issues as well.

Michael regularly litigates cases involving a wide range of technologies, including financial management systems, medical devices, aerospace and defense systems as well as technologies in the healthcare sector.

With his experience in the intellectual property and healthcare fields, Michael works closely with private equity funds, venture capitalists and startup companies seeking funding or those involved in mergers and acquisitions.
