Horrible Experience with Atty. Michael Dean Carter

Carter and other lawyers in his firm only represented me in a personal injury case. Opposing Counsel alleged that Carter failed to turn over WC medical documents to him in the personal injury case. Carter alleged that he never got the WC documents when he requested them. The legal counsel for the Wor...kers Comp doctors provided to me in writing that the WC medical documents were sent to Carters firm after they requested them in writing and that they were never returned undeliverable. Carter communicated with 2 of the WC lawyers I had and even referred me to one of them. Opposing Counsel alleged that Carter and his co-counsel sent out a subpoena in 2017 for medical documents without providing notice to him of the subpoena. When the Judge asked Carter what happened from the request of the subpoena in 2017, Carter's response was " I don't know." Opposing Counsel alleged Carter and his Co-Counsel also sent a subpoena to an out of town witness that the Judge told them they could not depose and that Carter and his co-counsel never conveyed what the witness would testify to and what the current address was for the witness they sought to depose. The witness never showed up for the deposition after Opposing Counsel told the witness that the subpoena was invalid. Ironically , the deposition for the out of town witness was scheduled after Atty. Carter and Starshak returned from Gerry Spence's ranch. The out of town witness was barred from testifying at the trial and one of the medical experts was also barred. Carter walked into court on the 3rd day we were suppose to be on trial handing me a copy of a motion to withdraw because I asked him to file a 4 page Declaration I typed up indicating that misrepresentations were being made by Carter and his co-counsel about me and that Opposing Counsel had also made misrepresentations. In the 4 page Declaration I stated that Opposing Counsel's statement that I'd told my supervisor what the injuries of the victims on the bus were was a misrepresentation to the court. I couldn't find anything in the transcripts on the day that particular misrepresentation was made where Carter challenged it. The Judge went with Opposing Counsel's misrepresentation. Carter was not allowed to withdraw but he told the judge he'd be willing to take a friendly contempt because he could not represent me any longer. Carter and Opposing Counsel suggested I could dismiss the case with leave to refile. Even though it was a time of massive confusion for me, I went with their suggestion to dismiss with leave to refile. Turns out I was not able to find another lawyer to take on the case because they'd look up the case and see all the sanctions the Judge dished out against me the client (not Horwitz.... ) and just say NO. One lawyer told me, " I don't know anyone that would touch it." I couldn't handle the case on my own because it required medical expertise that I don't have and experts require lots of money to appear for trials. I didn't have money to pursue a malpractice case either especially knowing the uphill battle of arguing what was a "viable case or was not a viable case" after I'd dismissed with leave to refile. I requested the audio of the 3 days of sanction motions vs. trial but, the court reporters would not provide the audio to me so, I only got the transcripts from those 3 days. By the way, Horwitz never ordered the transcripts from the 3 days of sanctions so, I ended up paying for originals of transcripts. Very expensive. I tried to settle this matter with Carter's malpractice insurance company but, she said her clients didn't feel they'd done anything wrong.

Excellent, hardworking and extremely knowledgeable!

I previously reviewed Mr. Carter and mistakenly rated him incorrectly It should have been 'Excellent' across the board. My case involved the tragic death of a family member and Mr. Carter always kept my loved one in the forefront of our fight. I would recommend him to anyone & everyone. I almos...t gave up but Mr. Carter fought the good fight and won. He's a tough negotiator and a very smart attorney.

Michael is not just my lawyer , he is my friend.

Since 2007 when my case started until it ended in 2012, Michael has been such an important part of my life. He and his partners at Horwitz, Horwitz & Associates fought a long hard fight and won. If I had any questions, problems or just needed to talk, Michael was a phone call away. During my trial... I watched and listened to Michael and was so impressed by his knowledge of my case and how compassionate he is.
