I have read and re-read this review many times. I am not able to identify your case from the information you provided. While it is impossible to meet the expectations of every client, I try to do my best to manage those expectations by explaining the mechanisms at play in each specific area of law. I invite you to contact me directly to discuss the outcome of your case personally. From what I can glean from your post, it appears you were involved in a car accident and suffered a traumatic brain injury. This necessarily triggers your ability to make a claim for no-fault benefits. No-fault benefits, by design, are intended to provide you with reimbursement of certain financial losses and payment of all reasonable charges for reasonably necessary expenses related to your care, recovery or rehabilitation of accident related injuries. The no-fault act is not intended to compensate you for your injuries. You must sue an at fault driver to be compensated for the value of your injury. Despite efforts to explain the distinct claims and the separate potential for recovery under each claim, clients sometimes do not understand why their insurance company is not compensating them for their injury and the medical providers who provided care, treatment and services without payment get paid out of your settlement proceeds. The reason is that, in those circumstances, you already were compensated through the services you received. In a no-fault claim, the categories of benefits and to whom they should be paid are very clear. There are only limited categories of benefits which are payable to the injured person. With respect to your claim that you "lost" your medical benefits, there are only a few ways to "lose" the medical benefits available under the no-fault act. You can settle your claim and agree to waive your right to seek future benefits. You can lose at trial, but you will only lose benefits IF the jury finds that you were not injured in the accident. Lastly, if the insurance company wins a motion to void your policy based upon a provision that allows it to void the policy if any portion of the claim is found to be fraudulent. I have never lost a trial where the jury determined that my client was not injured in the accident. I have never had a court dismiss a case based upon the insurance company's argument that my client's claim was fraudulent. I have settled cases where the client agrees to waive the right to future benefits, however this occurs only after a long discussion with the client and the client signing a Settlement and Release stating that the right to seek future benefits is waived. Lastly, you are mistaken in your claim that an attorney is prohibited from speaking with a treating healthcare professional without speaking to the client first. All clients sign a HIPAA compliant authorization which permits the disclosure of protected health information and communication. That's all that is required. Moreover, it is typically a good thing for the plaintiff attorney to communicate with the treating professionals so that the attorney has a better understanding of the client's injuries and treatment.
